Judge Amy Pellman is Looking Forward to Opening Children’s Court

Posted by admin  Published in Beverly Hills, California, Children, Courthouse ramblings, Desperate Exes, Hollywood, In the news, John J Nazarian, John J Nazarian P. I., Judges, Lawyers, Minor's Counsel, Monitors, Relationships, Stanley Mosk Courthouse, Straight Talk with John J Nazarian
Judge Amy Pellman

Judge Pellman

The Los Angeles Times has an article in the OP-ED section titled, “A Victory for Sunshine“ by Jim Newton. The gist of the piece is what I was talking about in my previous article regarding the opening of children’s court in Los Angeles…”No Mo’ Secrets.” if you are not doing your J.O.B. you might get some bad press. Not the children but the adults whose job it is, is to “do right” by the children.

Funny thing about people in the legal profession many like medical institutions like to hide behind the secrecy or as is often stated, “shield” those who work with children from any real scrutiny. Problem is this, just like a dampness hiding in the walls of a house with a leak, all may seem to be fine but a “mold” begins. Likewise when you have this secret society of the “well”-meaning you get the very same thing. The level of incompetence I have witnessed in my four years of covering the courts is frightening. I have watched lawyers screw up cases and I have watched some who acted like buffoons. I have documented this very behavior every time I have crossed paths with those who I saw as buffoons, much to the dismay of those “buffoons” I have written about.

Having the press in the courtroom is a good thing and much to the group of lawyers in Judge Pellman’s court it would have seemed that scalding water had been poured on a bunch of angry rats. The “scalding” occurred when it was announced that a reporter from the L.A. Times would be sitting in. One lawyer, Thomas Wayne Pichota was unhappy and stated that “Nash was wrong” and went on to discuss the issues of law. I called Mr. Pichota’s office and left a message for a comment and as of 2.15.12 no call back! Pretty soon the other lawyers decided to jump on the bandwagon and protest too. Judge Pellman is the ultimate bandwagon smasher, she told them it is reported “No.” “No” as to any delays and other legal shenanigans, (I use the word SHENANIGANS often talking about legal stuff, is is such an appropriate word). Here is a thought for some of these lawyers, good work can get some good attention! However being a gas bag and sucking on the public tit for fees representing children should be under review by those of us in the media and press. Taxpayers have a right to know, right? Someone in the audience (a lawyer) wanted to be sure no child’s name was mentioned…this is funny. I never mention kids by name if ever at all, but I do like to comment on the actions and behavior of lawyers!!! Judge Pellman was having none of it…note to the gang in children’s court, Pellman is tough and knows the laws pertaining to children as well or better than many in California and maybe the entire United States.

This system does not have to be private and secretive, some of these very same cases end up in the news and we all read about the disasters of the system. Having the media present may bring a more positive light to a group of lawyers and social workers who like having ‘No Sunshine’ in the courtroom…Pellman’s court is going to be court of Truth, Justice and for the children.

Note: For all of those public servants who do a good job and the professional whose practice is in the interest of children, this is all good stuff. It is those who like to be assured that any blunders will just disappear in time…the time has come!

Opening Children’s Court Is a Good Move in Los Angeles

Judge Michael Nash

Judge Michael Nash

Let’s give Presiding Judge Michael Nash a big round of applause and a standing ovation for having the courage and strength to open the courts to the media. For many years children’s court has been closed to everyone and everything…secretive comes to mind. This secrecy has encouraged INCOMPETENCE to breed and to go unnoticed except to those who sit in judgment..the judges and of course “the silent ones.” What has this “secret” society bred, INCOMPETENCE, and this judge and others are very much aware of this problem. Sure there is no John J. Nazarian with his note pad and Montblanc pen observing the goings on and writing as fast as possible…never ever interested in the children. What I am interested in is the INCOMPETENCE and silliness that I see very often in and around the court house on any given day.

What can one report on, let’s see, a L.A.County Sheriff Security guard aka “clown” or Minors Counsel making fools of themselves or the ever present group of fools known as “Monitors.” John J. Nazarian will listen and observe and report all for the world to read. I have been told that my presence in some courtrooms can make some uncomfortable as to what is “he” (me) going to write…this is just at the Stanley Mosk.

This new openness, if I am understanding this correctly, is what Judge Nash wants, he and other bench officers are seeing things that I think judges are finding disturbing and what is it that is disturbing? INCOMPETENCE of those involved in dealing with children and related issues in the Juvenile Court. INCOMPETENCE being shown by who, Hmmm lets see social workers? Lawyers representing children? and others! This is a little uncomfortable for a whole bunch of people,

“openness is profoundly unsettling in a courthouse accustomed to doing its work in private,“

as reported in the Los Angeles Times (2.12.12).

All I can say is that I am going to be showing up real soon and all I can hope for is that at least one INCOMPETENT player at the Children’s Court makes their presence known and I will make you and your INCOMPETENCE famous. And for all of you who try and get me thrown out of the courtroom…that makes you “subject matter” forever…I promise, and I do have a “Press Pass.”

Straight Talk with Celebrity P. I. John J. Nazarian’s guests tonight at 7 PM PST – 10 PM PST are Attorney Jeffrey Sklan and forensic psychologist Dr. Glenn Lipson.

Hollywood divorce & criminal lawyer, Jeffrey Sklan termed the saying; “SUDDEN INCOME DEFICIT SYNDROME”. Sklan is also a criminal attorney and often in a divorce suit he will have lawyers refer clients to him because of allegations of domestic violence.

John Nazarian specializes in assets that seem to disappear right before a divorce or during the divorce.

Dr. Lipson is Program Director as well as Associate Professor of the Forensic Psychology Program at Alliant International University, San Diego Campus. A Diplomate in forensic psychology he has evaluated victims, perpetrators and has been retained in suits involving clergy, youth organization and internet exploitation. He has appeared in an Expert capacity on local media outlets, Court TV/Sessions and the Verdict with Paula Todd. Dr. Lipson has worked with HBO and the Discovery channel. As a Diplomate in Forensic Psychology he has testified in homicide, sexual assault and other high profile cases.

Dr. Lipson is often called in to conduct tests and interviews to produce a forensic psychological report of the court.

The subject tonight is the high profile divorces of the rich, famous and powerful. Between the three of these men for one hour of their combined time would cost over $2,000.00.

All three of them also operate in the world of domestic violence. Sklan often has other divorce attorneys refer clients to him involving allegations of domestic violence, to prove it or to defend the charges. John provides security & investigative services to prove or defend charges. John also at times goes along for a “supervised visit involving court appointed monitors”, to assess if they are remaining neutral in the process.

This is your chance to ask this group of experts the questions you have. Is the domestic violence allegations true, or are they an attempt to manipulate a court for an upper hand in the proceedings?

From now until tonight at 6 PM PST you will be able to ask questions you want answer on three websites, here by sending an email to John, Desperate Exes.com & Rose Speaks.com by leaving comments or sending emails to either site or you can call in during the show to ask these questions.

More Monitor Madness

Minor's Counsel

Monitors are back in the news again. I was sitting in Department 43 and I am noticing that there is a mother who is pro per and taking a real shellacking from a MINOR’s counsel. This MINOR’s counsel is doing everything that she can come up with to attack and discredit this woman, even using big words that caught me off guard. I have to say that the “other side” even with his lawyer looks like Central Casting for the “Addams Family.” Now I am as critical as they come when it comes to these pro pers, but to watch the beating Ms. Ponce was taking was as bad as it comes comes. Minor’s counsel could have tempered her comments and did not have to be so vicious, after all she is an officer of the court. The attack was pretty severe and I DO NOT THINK IT WAS JUSTIFIED from where I was sitting. I went out and spoke to Ms. Ponce and told her exactly what I felt as to what I heard and what I was watching, not good. I will also say that Judge Willet seemed to give this young and well-dressed female minors counsel a big box to stand on and even to correct “His Honor” on a section that he misquoted. Beauty and intelligence, a tough mix to beat.

The best part of Ms. Ponce’s comment came when it was asked or written in a document, “what was the court ordered monitor doing?” In response to when the child was being “pushed” by his father during visitation? Response: “Eating and texting,“ at what $30, $50, ? per hour?

Hear me loud and clear, Monitors are a virus when it comes to your DIVORCE case, these nitwits are as bad as sand in the oil pan of your car! They are not impartial and will belly up to whoever can treat them better, they are generally a pitiful bunch who so want to be a “somebody” and quite frankly do not think many would pass any real close scrutiny. And what we are seeing are judges who will allow them to address the court in written reports and give live testimony! These people for the most part have NO TRAINING other than a 5-6 hour course they take to get the title, “monitor.” How this group has not been investigated by the Office of the Attorney General is beyond me based on just what I have witnessed and the false testimony given. Personally I am feeling that the judges do not always take what these people report with a “box of salt.” From my personal experience, many of these monitors are liars and cons all with the blessing of the court.

I can assure Judge Willet that when this monitor who was not ID’d in court (I know who she is) does show up for her “15 minutes of fame” she will lie and paint the picture that the minor’s counsel wants. This is one of the worst abuses of DIVORCE court I have seen! Do not get me started again with minor’s counsel, they act as an investigator and not a lawyer most of the time. And do I have to remind the Superior Court of the “issues” that this group created at one time?

So what do I do, I stroll into Judge Trent Lewis’s court and Judge Lewis is telling a pro per (male this time) that he is going to appoint “Henry Stewart,“ and to have Mr. Stewart use one of his monitors, great! This is a huge money grab and these monitors are being paid lots and are little more than a glorified security guard that can ruin your life in DIVORCE court. This pro per was polite enough but was insulted and stated, “I am not going to pay someone so I can visit my child” and walked out of court. That move was likely the smartest thing this guy ever did since entering the “Twilight Zone” called DIVORCE and “Court-Ordered Supervised Visits.”

One site promotes that it uses only POST (police officers standard and training ), certified law enforcement officers. Really? Am I to believe that will make everything all better? Spare me once again, go and look for yourselves the requirements of 5.20 Rules of Court Judicial Administration Standards…there is absolutely no impartiality in the way these people conduct themselves and it will be you that pays the ultimate price of what some of these hustlers will do or say to endear themselves to one side or the other and worse yet, the court itself.

Using a monitor or having one forced upon you by the court is going to be a disaster in most cases (my opinion). Knowing what you know today and could go back in time, would you buy a ticket on the Titanic?

Who’s monitoring the monitors?

Back on February 27, 2011 my good friend Victoria Kim and Kim Christensen of the Los Angeles Times reported that Dr. Joseph Kenan was being investigated for “posting lewd photos of himself on Facebook and allegedly promoting illegal drug use, unprotected sex and male prostitution.”

Ok, I get it and I might even agree with Dr. Kenan on some of these alleged accusations but here is the rub folks, it is as I have been saying all along, these SOB’s think they are so above it all and can make incredible decisions at outrageous fees and they are not fit to sleep with pigs, monitors and minor’s counsels…FOR THE MOST PART!

“Critics of the system say the courts do a poor job of overseeing the work of people who often play pivotal roles in the lives of vulnerable children. A recent state auditor’s report faulted two courts in Northern California for how they vet custody evaluators’ qualifications and training.”

Did I, John J. Nazarian, one of the worlds foremost Private Investigators say this very same thing just a few days ago on DesperateExes.com in talking about a “Monitor” aka “Shadow”??

You see I am again right on target on the problems of divorce in California and I know what I am talking about, twenty years of playing these divorce games under my belt.

“Critics of the system say the courts do a poor job of overseeing the work of people who often play pivotal roles in the lives of vulnerable children. A recent state auditor’s report faulted two courts in Northern California for how they vet custody evaluators’ qualifications and training.”

And if you think the courts do a bad job of vetting custody evaluators’ qualifications, go look at the “Minors Counsel” gang! LMAO…Oh I almost forgot, “Monitors” are even less watched. Funny no one watches the watchers!

It was reported yesterday that the state medical board was not going to take action against Dr. Kenan, “a complete investigation was performed, including a subject interview. We then retained an expert witness to review the case, which resulted that there was no evidence of professional misconduct”, by a board investigator.

There were concerns that Dr. Kenan was asking for tens of thousands of dollars for developing custody plans for children…certainly not compared to what many of these BIG MONSTER Firms charge…tens of thousands v hundreds of thousands…’no honor amongst thieves,” again does anyone else find humor in all of this?

Interesting, I for one say Bullshit, these licensing agencies cover the asses of many of these doctors like a horse blanket and maybe it is Horseshit that I smell. As an old cop, I have to say where there is a little smoke there has to be a little fire, welcome to the world of divorce in Los Angeles. Dr. Kenan is quoted as saying, “My comments are entirely in jest. In fact, my comments serve to educate the community’s problems through satire.” Just like us here at DesperateExes.com

This Shadow doesn’t have a clue

Posted by admin  Published in Beverly Hills, California, Children, Courthouse ramblings, Custody, Desperate Exes, Divorce, Hollywood, John J Nazarian, John J Nazarian P. I., Lawyers, Minor's Counsel, Monitors, Private Investigators, Relationships, Stanley Mosk Courthouse, Straight Talk with John J Nazarian, Tactics

Well, like most days my life is full of very high-priced lawyers and great offices and all the crazies that come with that. Associates who want to be partners or are looking for the pat on the head for doing a good job of billing hours. The parking attendants at the office buildings…NOT! And all of the others who show up trying to sabotage DIVORCE or CHILD CUSTODY issues. Today would not be any different!

The other night I get a call from one of my clients and she is just beside herself, this is a very tough situation as in many cases we have a mom who has raised her son on her own with the help of her mother as she is a professional and has to work (sounding familiar here?). She commences to tell me that “The Shadow“ who has been retained to WATCH her Husband is menacing her verbally. One comment, “you are a nice couple, you should get back together”…Huh? She gives her a flyer on some child issues…could this be? My client wants a meeting with her lawyer, I tell her I will take care of it.

Well, I contact the attorney who my client hired and it happens that I have known this lawyer and her husband for years. I adore them both and she, the DIVORCE lawyer of the two, is a power house of a lawyer and like myself, not a graduate of Burger King in so much as you will not be getting her services “your way.” I call and get the lawyer on the line and she sets up a 9 a.m. appt. the next day. This is to discuss the “Shadow” or “monitor,” another group all of you in the throes of DIVORCE who are going to pay for if some issues should arise as to your character or experience in being with young children and your ability to take care of the little ones. Keep in mind, folks, you are dealing with me here, I am not impressed with many who are involved in this DIVORCE stuff, evaluators, shrinks, and now we got MONITORS. The training for a “monitor” is more bullshit, I got more training on how to spit shine my shoes in the Navy.

My dog Charlie has more hours of training on how to sit quietly than the ridiculous 6 or 8 hour classes these “monitors” take. Also keep in mind some of these people can do real damage to a DIVORCE case out of just being fooled by one side or the other, real damage. In this case I am not going to let this happen, I have twenty years in this game of investigations and security and have seen every friggin circus this town has to offer me! And this is not going to be any different, read on… Whoever came up with this crap has to be laughing all the way to the bank…are the family law courts really this screwed up? Minors counsel talking to little kids who can’t speak and now monitors, too?

My client, who happens to be a medical doctor, is telling me that this “Shadow” is just terrible, and that she is speaking to her as if she is an idiot and is “dictating” and is a nightmare to deal with. When I talk to the lawyer she tells me pretty much, “she is like a Jewish Grandmother“ and that she thinks she is doing a good job, the “shadow”…Hmmm. On Grandma Phil’s site, “KIDZ FIRST”, there is this quote, “with me, your children are in the next best hands…GRANDMA”!! OMG! This lawyer thinks that “Phil” is the cat’s meow, I am going to find out!

The meeting with my client and the lawyer lasted about an hour and I can tell as does the client that the lawyer is not believing anything that the client is telling her about GrandMa Phil. Much to my surprise, the client fires the lawyer on the spot, and we are on our way out of the office. The client asks me, “John can you come to my house this afternoon about 5PM to observe the exchange?” Sure I figure why not, how bad can it be, “GrandMa,“ and if all goes well, then maybe the lawyer was right!

I arrive at about 5 P.M. as I am too billing by the hour like the “Shadow” and the “Lawyers” and why not? This is a money making opportunity is it not, DIVORCE. I maneuver my very large SUV into where I see a spot behind a white VW, a nice new one, one of those expensive ones, long and sleek (why not look at GrandMa Phil’s fee schedule). Well, this older women gets out of her car and as she walks past me she is giving me the “Stink Eye”…the look. She has a real puss on, as if someone had just shit in her cereal. I have not said anything, frankly I am wondering if she may have pepper spray hidden in her drawers. I have not even gotten out of the SUV (by the way, I am talking to the lawyer’s husband who hired Grand Ma Phil on the cell). I get out of my SUV and as I walk past “Phil” I get “Who are you?!!!”, very assertively and with a tone to think that I have to answer…I have just met “Grandma Phil.”

Note: she is not intimidated or afraid now…just wait. My immediate response is “NONE of your Business” and “WHO are YOU?“…now I am really getting the “Stink Eye,” she is morphing into “one eye granny.” I go into the house and sit in a rocking chair, soon “GrandMa Phil” and the client’s husband, who has no parental skills, are at the door. My client opens the door and “GrandMa” comes in as if this is her house and her mouth is in gear and the brain is in runaway neutral. Once again I get “who are you?”, so I tell her I am a private investigator and I am employed by “her new attorney” referencing my client. “Phil” now decides that she is going to do some questioning, she parks her ass on the couch and is making comments and demands of my client. She wants the lawyer’s phone number, I tell her, she hired you, you should have her number. She demands the number from my client. She then demands the name of the new attorney, I tell her she is not getting it. Once again, what kind of a “shadow” is this, quite possibly the noisiest I have ever heard…she won’t shut up! She then states, “I don’t like this, a private investigator.” She calls information to her employers number and tells her, “he parked right behind me…he is intimidating.” Where was I supposed to park, on top of her very nice import? “Intimidated,” not when she confronted me on a public right of way!

Well it does not stop, I tell her, shouldn’t you not be sitting here and be on your way out the door with the “dad” and child and acting liking “Grandma” for a day in the park??? No, she is sitting on her ass on my client’s couch in my client’s house making very very negative comments about her. AND paying no attention to the husband and child she is supposed to be the “Shadow” for…her new title could be “pain in the ass.”

“As a visitation monitor, I am focused on the safety and comfort of your children. Through her training and experience, Phyllis is able to stay focused on your children and remain impartial to each parent. Her reports are based on FACTS and not on any type of judgements.”

She was as impartial as my choice of having an eclair or a cupcake, please, it was painfully obvious by her comments directed at my client and her behavior that she was way out of her league.

“I have an AA degree in Psychology and have been trained to deal with disabled and emotionally challenged Children”

Well so much for that “A.A. degree,” and so what, with that degree am to expect that my son who took a CPR course can now do heart surgery? Just silly, from what I witnessed yesterday, Granny would be well versed to do child care at the local State Prison on visitation days. However she would have to put her big mouth in check.

At some point I guess “Phil” figures her fees and time are running and takes the husband and child to the park, AS SHE WAS SUPPOSED TO IN THE FIRST PLACE! And not be camping out on the couch. The two hour visit is cut short and they are back at my client’s home in about an hour and forty minutes (two hours were allowed). This went easily as “GrandMa Phil” remained outside as the child was brought to the door.

Well, here is my take, this “Shadow” was beyond less than professional, her comments in front of me to my client were anything BUT “impartial.” And I guess if her high dollar import ever fails to start that maybe a broom could be substituted! All I am saying here people is be VERY CAREFUL OF THESE PEOPLE, they have less training then Boy Scouts…and BEWARE of signs that talk about “home cooking”…“just like home“ and “Grandma.”

“Grandma Phil” was offered an opportunity to comment on this story but declined.

Minors Counsel v. Private Investigators

Posted by admin  Published in Minor's Counsel, Private Investigators

Here is a thought that I have for the California useless P.I. clubs and organizations: why is it that we have “lawyers” aka MINORS COUNSEL being appointed at a pretty decent per hour rate, $125/hour? If you should be so lucky to be appointed and the parties involved are rich and maybe a little famous the sky is the limit…it is absolutely incredible, you can bill your regular hourly rate. Now if you are one of these high dollar lawyer types do you have any idea what that number can be? And for some children who can barely whisper “goo goo gah gah,” this is the truth here and I am shocked that this has not been mentioned before.

There were two cases last year that were nothing short of spectacular for two divorce lawyers who billed tens of thousands on one and hundreds of thousands on the other. Forget about the CONSTITUTIONAL ISSUES involved, some of these minors counsel have a great deal of power. They can make decisions and they get to testify for the minor, LMAO in “their” own words…oh my god! And listening to some of these people is terrifying, to the point that I even can tell that they are ‘gilding the lilly’ aka making stuff up and certainly enhancing the work product, my opinion.

What you ask is my complaint? Simple, they are acting as investigators 70 percent of the time and not as lawyers. To the point the other day I sat and listened to someone I had to describe as nothing but a wind bag with a Bar card. And I could tell by his answers to the court there was a “quiver.” Sure, that uncomfortable quiver sound I can remember when I would be interviewing an arrestee as he sat and lied to me (back in the old cop days). Oh please do not stop me now, this windbag stated, “I have not finished my investigation“ and “when I am finished investigating I will know more“. Now here is the other thought that I have: Minors Cousel is nothing but a money grab for most of these people who specialize in representing the children. Much of what I have seen could be and should be handled not by lawyers but by the police or other more appropriate governmental agencies. Or by licensed California Private Investigators, simple! Do they have a purpose? I and many lawyers I have spoken to are not sure and many agree with me that they operate as INVESTIGATORS and are NOT licensed to do so. And INVESTIGATING in an official capacity is a violation of the law in California.

Anyone questioning my clarity on this, all you have to do is go and sit and listen, most of the time they are not acting as lawyers. There is little or no law being dealt with by them, rather jibberish and bullshit with a dam near guarantee to take a big bite out of your financial well being. The other interesting aspect I have seen is when there is a blatant like for one parent or the other and they are supposed to be impartial and to deal with the facts in their INVESTIGATION. I am still sizzling at how about this? These people are speaking for a child that as I have stated that in many cases can’t express themselves. So in making mention of this again, I plan on paying a lot more attention in the weeks and months to come and when I see other MINORS COUNSEL being INVESTIGATORS I will have their names and dates so that you can pull the record and see for yourselves. This group of lawyers are not only flying under the radar of a real lawyer (sometimes), but they are taking money out of the pockets of investigators right under our noses with the blessing of the court.

Some lessons from Daman Wayans Jr.’s day in court

Posted by admin  Published in Child support, Children, Damon Wayans, Jr., Judges, Minor's Counsel

Damon Wayans, Jr.
Always the place for interesting stories, the Stanley Mosk Superior Courthouse…and I love this place as you can learn, yup I said it, learn. You will learn what to expect when you decide to pull the trigger and divorce ol’ Useless. That could be either a him or a her, most often it is him but sometimes her. As I have often stated and believe with all my heart, by sitting and listening in the courtrooms here, you will hear what you should and should not say.

Today in Department 88, Judge Gordon’s court, I stumbled in and a few moments later the Wayans case was called. Damon Wayans Jr. was there as well as Aja Metoyer, the mother of one of his children. Aja was with her lawyer, Eric M. Moses, nice address, 1901 Avenue of the Stars, 2nd Floor, Century City, nice. Damon was pro per. Mr. Moses has been in the legal field for 20 years and family law for 5, he should have gone into defending drug dealers and perverts, they pay better! It is my opinion that Mr. Moses was attempting to do a couple of things. My initial piece on this was a little rough on Mr. Moses. The judge advised him that he had the wrong sections filed for what he was asking for and one thing was very outstanding. Mr. Moses wanted to see about getting paid…LMAO! It seems for some divorce lawyers this is no problem at all. Mr. Moses was trying to get paid and he is entitled and it is the rule, that he/she who has the money has to pay. Is this fair, I don’t think it is always but at times it is needed, litigation is costly. My advice to Mr. Moses, get some money up front…it might be all you will see.

Ms. Metoyer made a fatal mistake when she put her mouth in gear and left her brain in neutral. She clearly stated “My child,” people, it is always “Our Child,” no matter how jealous you are and how much you cannot stand the new “Mrs.”, keep it real, it is always about the children and not you, the jealous hateful parent. Mr. Moses should have given his client a heads up as to what is appropriate and what is not good to say. This misstep is often a clue to the court that there is a problem. A problem that is being channeled to the children in an attempt to alienate one parent towards the other. All in front of her lawyer…I do feel that Mr. Moses should have had a lid in his hand to cover her pie hole as I could tell that she is one of those who need “mouth control.” What Damon Wayans Jr. was asking for was reasonable and fair, and he came across clear as a bell and likable. Ms. Metoyer was also likable in her own way, but she also came across as still feeling very jilted and very jealous towards Mr. Wayans’ new family and his kids from that relationship. Then came the cheap shots from Mr. Moses in trying to salvage what was a bad day in court for him. When I say a bad day in court, Mr. Moses and I spoke recently and he explained to me the difficulty he was having and was on board to make sure that Mr. Wayans has a place in the children’s lives, and I believe him. And folks, I believe what he was telling me.

Speaking for his client and trying to do her bidding, it was stated that when the children stay with Mr. Wayans they are not fed, they don’t do homework and they don’t bathe…I say BS. It sounded juvenile and worst of all a cheap shot. Judge Gordon warned the parties that if they continued to throw accusations around that “third parties” would have to get involved. That would mean evaluators, psychologists, minors counselors and a gaggle of misfits that would work up some bills that will make you wish you never made those silly accusations in court. Folks, to some degree this is a vicious game, and being cute and cutthroat will only work against you and your wallet. Note: Lawyers throwing “cheap” shots is also a BIG part of the game.

Again Mr. Moses made a plea to the court for money aka “support,” and made an interesting comment that his client “has not worked in years”…about time girlfriend finds a career. Damon Wayans, Jr. has been paying and being as fair as he can be, my opinion. Then Judge Gordon made it clear what that was going to be and that too is a very ugly time for the person paying. Again, keep it real or one of these bench officers is going to make it real, very real. My advice to both of these people, Mr. Wayans you did good today, Ms. Metoyer you did terrible today and after a closer look, it was your fault. As I stated above, your lawyer should have had a lid or been able to pull the plug to keep you quiet. I for one think that if you bury the hatchet and think clearly of where you want to be at some point, speaking for yourself would be the way to go. But after a second thought, I think your speaking for yourself is not an option, KEEP MOSES!

A Major Minor’s Counsel

Posted by admin  Published in Divorce, Minor's Counsel

Never ever…or at least seldom…do I refuse to change my mind or position on any subject. Including my thoughts and beliefs on divorce. The other day I was in Commissioner Scott Gordon’s courtroom and I was listening to Jeff Sklan, Lawyer, bury his client’s slouch of a former husband and he nailed him. And I can tell, you are all wondering what did this Big Shot Beverly Hills lawyer use to seal the slouch’s fate? Minor’s Counsel. Now all of you who are fans of DesperateExes.com know my feelings on “Minor’s”: great for digging gold and silver from the mines…but be careful as they will also “mine” your wallets!

Rose Marie Gallegos, EsqWell this very well-dressed woman steps forward and gives the facts, and does it in a such away that the “slouch” never saw the pick-ax! That is, until it was right between his eyes. That Minor’s Counsel was Rose Marie Gallegos, Esquire. When Ms. Gallegos had finished it was just perfect. Commissioner Gordon asked, “Comments?” and with the perfect smirk Mr. Sklan simply stated, “I agree with Minor’s Counsel.“

Now what you ask did I like about this Minor’s Counsel? Simple, she spoke and acted like a lawyer and not a private investigator. What has happened, and I do not understand how, is that Minor’s Counsel more often than not think and act and speak like private investigators. More often than not it is a lawyer that is needed, but with a licensed private investigator and with a lawyer playing second fiddle. I ask anyone with the knowledge of what a P.I. does to listen to these “orations” that are often performed in the courts for the benefit of a minor and tell me I am not on target. How this whole thing got snuck in under the noses of the controlling office of investigators is not clear, but it did!

My admiration for a job well done, Ms. Gallegos. She looks to have some special training and best of all, she was dressed beautifully, nice…with class!

PS: I attempted to call Ms. Gallegos at her office and got someone on the phone who wanted to play “20 Questions”…you know, you ask to speak to someone and suddenly you have to take a quiz. Screening calls has its place, but I am not good at answering ridiculous questions.

Argh! Minor’s Counsels plunder the booty

Posted by admin  Published in Custody, Divorce, Lawyers, Minor's Counsel, Money

Minor’s CounselHave you felt the “hum” at the Stanley Mosk Courthouse? Yeah, it is the “hum” of people talking about “MINOR’S COUNSEL,” aka, “I have a fast boat and a flag with a skull and crossbones, lets take a cruise.” Several lawyers who I respect have mentioned this to me and I too have noticed the power these attorneys have in the capacity of being appointed by the courts as “minors counsel.” You would almost expect them to show up looking a little grandmotherly or a little fatherly. I am actually a little taken aback that they don’t come to court wearing a patch over one eye and a parrot on the shoulder. All the more that makes one wonder what is the actual purpose of these lawyers who get these real lucrative gigs working with kids? Kids who, by the way, under any sense of normalcy would never see a psychologist , or a counselor (unless at school) or for that matter their own attorney, to protect their rights to see if Sunday is better than Saturday for an “overnight,” or that mom cannot fry an egg, or dad does not seem to know how to operate the washer or the dryer. But now they have the misfortune to have two parents who are getting divorced and thus they have their very own Minor’s Counsel…or is it “Miner’s Counsel”…LMAO, I just had a vision of a bearded guy with a shovel digging in a mine and bringing gold ore to the surface.

Folks if you happen to be in court one day and the judge mentions “minor’s counsel,” you too may want to hum “IT TAKES A WORRIED MAN TO SING A WORRIED SONG”. Do not get me wrong here folks, I too was a court appointed investigator many years ago and made a fortune, oops I meant to say a comfortable living, being appointed to represent people who had been arrested, and worked on their defense. It was great, the cops arrested them, the D.A. prosecuted them and I got to defend them, all being paid for by the county (not L.A. by the way…I never thought that the tax payer ever really got it)! It was great!

Back to “miners counsel.” It has been reported that one lawyer who represented a celebrity who had to stop constantly to get coffee and smokes got paid in excess of $400,000 dollars to represent two kids that couldn’t say “poop,“ and there is another one that has made in excess of $100,000 — for what exactly no one can figure out for sure. Now, what I just wrote is for those of you with MONEY and what a gift it is to be appointed by a judge to one of these cases, famous rich people!!! Cha Ching. They will show up for every hearing, every interview I am sure they would not miss even your kid’s bris, this for all my goyim readers is a circumcision. Now for all of you who are wondering about the working class and the poor well you could be ordered to pay half or NO PROBLEM, the county will pay “Da Miner” $125 an hour, and no cap! Take the kid to dinner and a movie and “bill baby, bill.” This is great money, as many of these people could not present a case in court if their life depended on it…not all, but many. So this is great, it is a little like a guy who goes to school to fix cars, he can’t fix crap, so he just moves the cars for the mechanics to fix, very similar.

And wait till you see these “protectors of the children” make there orations in the court room….OMG, this is not funny and can kill your chances of making any headway in your divorce. And most judges that I have observed give these “Miners” free rein to run one or the other or both parents right into the ground. For all my cat lovers, ever notice when your cat drops a smelly one in her kitty litter, well the burying action is very similar to what minor’s counsel can do to whatever position you thought you had in your divorce. And I have seen a few instances of that, “look judge what a great job I did,” did very much appear to me to be a bit over the top…way over the top. And quite frankly are all of these appointees thinking clearly? One or two I have seen appear, how do I put this delicately, NUTS!

Moms and Dads, god help you if your kid is smart enough to play a game on their sometimes overzealous lawyer aka “Minor’s Counsel,“ Oh No Mr. Bill! What real expertise do these people have to deal with children and to interpret what they say and do? Let’s see, a JD degree and a class to be qualified to deal with the children of people going through a divorce, and POOF! it is “show me the money!” My opinion, for the most part this is an appointment with too many flaws. That is the truth, they take a class to get appointed to the panel, LMAO for a few this has been the equivalent of winning the lottery! I ran a juvenile division for a couple of years and I know juveniles and this minor’s counsel thing has to be one of the best gravy trains I have seen in years. More to come on this matter in the next few weeks. …..
