Rumblings around the Stanley is that Judge Elizabeth R. Feffer is going to be leaving Family Law Court aka DIVORCE court and going to civil. We at DESPERATEEXES.com will be sorry to see Judge Feffer leave, IF THIS INFO IS CORRECT! I have to say that the comment comes from a source close to the action.

As my good friend once told me, she was happy to leave and could not be happier in the Civil Courts, Donna Fields Goldstein, one of the greats of Divorce court!

Talking about leaving the DIVORCE aka Family Law Courts, how many people have told me how much they miss Judge Amy Pellman? Well I sure do, first we lost Judge Goldstein and then Judge Pellman…some of the best times I ever had were watching these two judges tear “The Liars” to pieces! One day we hope they come back, we can all hope at least.

Leave it to me to find those in need of a good firing or more training — security at the nation’s court houses is critical and something I personally support!

Problem: at the Los Angeles County Court houses we have “court security guards,” these are L.A. County Sheriff’s staff people who were hired to save money by not having real L.A. County Deputies in positions that could be staffed CHEAPER! The folks in the “white shirts” and sometime BIG ATTITUDES. Don’t be angry at the public that you cannot become a real cop…I had nothing to do with the denial! And folks you get what you pay for.

A few weeks ago I had to pick up paperwork for a late filing at the Stanley Mosk and was parked at the curb at by the Music Center. Out comes a guard with the “white shirt” NO GUN with his famous badge pinned to his shirt (mistake number one is giving a badge to these people). I understand that this badge is not always on his shirt, just a rumor. Why not a sew-on patch in lieu of a badge (more on this badge later).

I believe that I read his name as Sheriff’s Employee Gonzales aka “Monster.” He tells us to move, and the way he tells us is “I am in charge and some moron gave me a ticket book.” We all have had these encounters with real cops and you of course move and fast. For a “Guard/Security”…for me I ignore them and hope they go away or call the real police, most are incompetent and a public nuisance. Sheriff’s Employee tells me “I will issue a ticket.” Problem: when did these non-sworn incompetent boobs get a ticket book? I tell him “write the ticket”, Sheriff’s Employee takes out what looks like a ticket tablet that normally goes into a black leather carrier from his back pocket and is slapping it against the palm of his hand and walks to the back of the 2011 SUV. After a few minutes he comes back and says “there are no plates,“ at which time I tell him that the SUV is new and does not come with plates…now Sheriff’s Employee Gonzales is confused and after a few moments of thinking asks for registration…when the county sent this dummy to “ticket writing school” someone should have told Sheriff’s Employee to “SPEAK to the driver”…I was a passenger, he never told the driver of the vehicle to move!! Finally the driver drove away. The last thing Sheriff Baca needs is a security guard being nicknamed “Monster“ for being over-zealous with a TICKET BOOK and writing lots of tickets(bad PR)! Tickets should be written by a Deputy not one of these budget busters that took a deputized position to save the county money.

NOTE: Is this the same Sheriff’s Employee (non-sworn as in no peace officer status) that attempted to break up a family disturbance where he lives by barging in and showing his little BADGE??? These kind of calls for the real police are some of the most dangerous when on patrol. Can we assume for the “Monster” this is easy “buzzing” potential combatants to stop as he is the law? And how often does Sheriff Employee ‘buzz’ people when out of his Sheriffs Employee uniform…TAKE THOSE BADGES AWAY SHERIFF BACA! Employees such as these will only cause problems at some point for the Sheriff’s Department and the Sheriff!

Sheriff Lee Baca is, for those with the knowledge and history of the Los Angeles County Sheriffs, nothing short of a breath of fresh air! “Oh what does John J. Nazarian know?” Lots, I met Sheriff Peter J. Pitchess a few times when I was a teenager, and I met him again as an adult at the memorial and funeral for Deputy Arthur E. Pelino. Art was murdered after an altercation with an alleged mentally ill subject March 19, 1978 (Art was my advisor along with Bob Warford at the old Newhall station and several hours after Art was murdered I picked up his body from the coroner’s office and took him to the Pierce Brothers Mortuary in Eagle Rock and it was there that I embalmed and prepared him for his funeral).

Peter J. Pitchess was one of the most powerful law enforcement figures in the world in his day. He came from the J.Edgar Hoover school of law enforcement, no body in there right mind would ever take on Pitches or for that matter J. Edgar Hoover. Both Peter J. Pitchess and J.Edgar Hoover were cut from the same cloth. They knew how to control anyone and anything that was a threat to their reign, and these two guys both “reigned” and some may have described the administrations as a reign of terror, I call it genius, pure genius. Pitchess from 1958 to 1982 was the sheriff of Los Angeles County, please keep in mind that he had served 12 years with the F.B.I. under guess who? J.Edgar Hoover was the Director of the F.B.I. from 1935 to 1972, look at the time these two legends in law enforcement spent in the “saddle.” Nobody would dare or wanted to be on the bad side of these two men. All that I have to say is “perfect,” there will never be another law officer like Pitchess or Hoover, well at least not till after the revolution.

Now we find the one person who is nothing less than a breath of fresh air, Lee D. Baca. Baca joined the department in 1965 and was sworn in as the Sheriff of Los Angeles County in 1998, I and a few friends had breakfast with Sheriff Baca the morning of his swearing in as “The Sheriff” at the Armenian memorial. Say what you will about the current controversy as to the care of prisoners or as they are referenced today as “inmates.” Modern law enforcement and the expectations of society makes the job of a sheriff or chief of police (particularly in our multi-cultural cities and counties) tough at times and why do you ask? Demographics is the word that comes to my mind, Los Angeles has slowly and continues to be a residence of third world types. Baca has bent over backwards to make his department accessible to all who wish to express themselves, is as they say in Yiddish, a ‘mensch’, a person of integrity and honor.

Sheriff Baca is responsible for 9000 sworn personnel and 700 reserve deputies, wait it gets tougher, he also has 7600 civilians. Can you even begin to imagine the havoc a group like this can cause? Also keep in mind that the old days when you had to be just short of a saint to become a L.A. Deputy is gone. Departments in the modern days of law enforcement are to make policing a mirror of the communities they police and to some degree that too is a problem few want to discuss. Sheriff Baca has made changes to this department that few would have had the strength or confidence to make, Lee Baca made those changes when no one else would.

Sheriff Baca is responsible for thousands of prisoners and perhaps some of the worst scum of the earth that is available for critiquing, think about it. Nothing will ever be perfect in the county jail and no one is going to make it work perfect. Funnier yet is that when many of these prisoners were on the street they did nothing but create havoc what it must be like to keep thousands of them penned up! In short Lee Baca will overcome these issues that are being drummed on in the media like “the sky is falling.” It almost seems to me that the issues are more political and socio-economic issues than one of failure of Sheriff Baca’s administration or his abilities. For myself and DesperateExes.com we support Sheriff Lee Baca and always will, great Sheriffs are hard to find!

Closing thought, in Maricopa County, Arizona none of these complaints would make a blip on the radar…why, you ask? simple the citizens in that county support law and order and tend to be elderly and retired, and Sheriff Joe knows how to keep the bad guys in check, “socio-economic.”

It is always a pleasure to report that a change is coming to the Los Angeles Superior Court, family law divisions aka DIVORCE court. Judge Scott M. Gordon has been chosen to take over for Judge Majorie Steinberg as the supervising judge of the family law departments at the end of the year. And if that was not great news in itself, Judge Thomas Trent Lewis will be the assistant supervising judge, can it get any better? This writer does not think so.

There is no secret that both of these bench officers are two of my personal favorites and that of our site DesperateExes.com. We were big supporters that Commissioner Gordon be appointed judge of the superior court, and he was. It was obvious many people felt that it was time for this appointment and as history is proving it certainly was the time. Judge Gordon’s background goes from street cop to prosecutor and at one time serving at the Hague with the international Criminal Tribunal for the former Yugoslavia in 1997. The decision to choose these two is brilliant and we at DesperateExes.com are applauding this decision.

The other wonderful news is Judge Thomas Trent Lewis, this guy like Gordon knows the game and the games that people like to play in DIVORCE court and was destined for this job as a judge, he is “Judge Lewis.” Sitting in either of these courts is better than any court TV show I have ever watched. Seldom do I ever exit either of these courts not amused after having listened to the lawyers and their clients try and play word games with these two judges (most of the times it does not end well.) It seems only natural that Judge Lewis be chosen as the assistant, Judge Lewis was one of the first attorneys to be certified by the State Bar as a family law specialist in 1997. Judge Lewis is a graduate of UCLA and University of La Verne San Fernando Valley College of Law. Judge Lewis was appointed to the bench in 2006, prior to being appointed Lewis was a partner at Rehwald, Rameson, Lewis & Glasner…nice! The courts in California are in a very serious state of flux and it does not look like it is going to get much better anytime soon. For any jurisdiction to have the dedication and attention to duty that these two bench officers have is better than money in the bank. Judges Scott Gordon and Thomas Trent Lewis are the best examples today of “The Buck Stops Here.”

And again I warn all of you going before either of these two, get your Sh*# together and keep it straight, for if you don’t you will leave these courts feeling as though your life is about to change for the worse, and you will be right! Tell these two judges the truth and you will be treated fairly, my opinion.

Judge Silverman what a mistake you made! Last summer a “monitor” was appointed by the court (you) and the behavior and activity of these monitors is just the worst! I have to wonder what is on the court’s mind to allow a “monitor” to stay in a mansion in Encino? And to live the “Life of Riley,” how I ask is this going to be impartial on any level??? Along with living “fat,” the “impartial monitor” is getting paid all this money, staying in the house, having access to everything that a wealthy basketball player can provide, she must have felt like a firefighter, sure getting paid while she slept. And a private chef to provide meals for the family…LMAO, oh for sure “lots of impartiality“, please!

And then have the ability to travel all over the city and god only knows where else with this very wealthy basketball player and of course the baby! A thought: Why not have them work in shifts, so as to keep everyone honest, to have one person almost move in and live such a lavish lifestyle under the pretense of watching the child is a total crock. This is a total conflict of interest and any touch of reality or impartiality of a situation is thrown out the window. Just like Judges and cops, when I was a cop you could not take stuff for free and judges don’t accept gifts…but take the 6 hour monitor test and get lots of free stuff and perks too!!

At one point this monitor told the mom, “Don’t worry I will be your eyes and ears,” HUH! It was a total stooge routine, mom got her ears pulled and poked in the eye by this “impartial monitor”. Keep in mind, this monitor was staying at the mansion for two to three days a week for a month….CHA CHING!!! Just another financial windfall to the “impartial” monitor. There was a time when ‘Lacey’ came to relieve the “owner-monitor-her boss” and ‘Lacey’ told the mom that this was all a big act (but to someone who has never lived like a rock star this was just a dream come true)…but that she could not cross her boss and say anything (Lacey is not the real name I have changed it).

I am getting more calls then I can answer in reference to my experience with monitors. I know when something stinks and I was right again. Even worse yet, someone called and told “mom,” ‘you have got to get rid of her (the court appointed monitor) she is talking real bad about you’…these “impartial” monitors get to write reports.

THIS WHOLE ISSUE SHOULD BE INVESTIGATED BY EITHER THE DISTRICT ATTORNEY OR THE CITY ATTORNEY…someone needs to get this scam under control. To all the judges in family law courts you need to pay attention here. It does appear to me that the judges in some of these divorce cases are being totally hood-winked and moms and dads are getting screwed!

My advice to all of my readers, listeners and clients is to NEVER TALK to MONITORS ALONE and ALWAYS have someone present to witness and to listen to what is being said. My client had to park her SUV on a busy street as “dad” would not let her pull into the driveway to put the baby in the car seat…wanna bet that never got put into any report…

Well you would think that the “adversarial” nature of our justice system would sink into the minds of those who try and make a living working within it…sometimes it does not, read on this is getting serious. After speaking with Phyllis Block yesterday and asking if she wanted to make a comment for the story I was writing she said no. Ok, that is fine.

At 4:20 PM I received a call from her son, Glen Block, he was trying to have me understand what a nice woman his mother is…I agree, I am sure she is the best of the best as moms go. My perspective is from who I am and what I do to report on a system that is not working well, as I am sure many would say what a wonderful human being I am…go ask my sons. This is my observation of what I saw and the behavior of a monitor or “Shadow.”

Well, I explain to Glen my mother is dead and I was adopted so doing the “your mom and my mom” thing is not the way we should head. He then asked further questions and I told him that it would all be in my declaration for the court. The story titled “This Shadow doesn’t have a clue“ got up and running. I was very careful not to use his mom’s whole name and in general it is a story with a point and of course my “point of view.”

At 9:36 AM this morning I was at the courthouse when Glen Block called again, this time, “you know who this is?” I made a comment and then Glen Block stated, “I am coming to your house,“ “I will be there in one hour.“ My response, “you do the right thing“ and hung up. All of this is adding up to what could be a very serious issue for someone and who, I don’t really care, everyone has to do what they have to do.

If this low-level intimidation is an attempt to stop or divert the freedom of the press and/or writers like me around the world it won’t work. Quite frankly, I guess we can all go visit each other’s houses for breakfast one place, lunch at another and supper at another. The other fun thing is that we are all close and within the jurisdiction of the Los Angeles Police Department!!!

Funny thing is this, does Phyllis’ son think that his kind of behavior is going to be good for his mom and her work? Glen let me share this with you: lawyers and the courts don’t like to be in controversial situations…especially with services and people they hire!

Leila Shennib gets a five year restraining order against Jose Canseco! Yup, you are “out!” The gorgeous swimsuit and glam model got the BIG “You’re outta here” restraining order against the one time baseball player Jose Canseco. This guy was the cat’s meow when I was much younger, he was huge in the world of baseball. Leila was given a temporary order on July 21, 2011 and the order became permanent the other day.

I remember when Jose had his Rolls Phantom repo’d, can’t lease a big boy’s car and not make those big boy payments. I believe it was BMW Credit if my memory serves me right. Jose, like so many it would appear, is still searching for his lost fortune and most of all “The Light,” that being his career.

Leila was quoted “I really did love him, so all of this is hard for me. I just can’t take his torture anymore. He’s so manipulative.” LMAO — I know the feeling, I have the same feeling for good ice cream.

On a happier note, I dropped in on my good friend Judge Donna Fields Goldstein. Judge Goldstein was looking fabulous and at peace! Judge Goldstein is at the Burbank Superior Court assigned to civil courts. Let me just say this, I miss her so much from her days in DIVORCE court at the Stanley. When I say at “peace” not like as in dead, but not having to do deal with a daily dose of the “Liars Club” aka divorce. The judges in divorce court should be paid at least or close to what many of the lawyers are getting paid who stand before them or at least a percentage (I know I know, just a thought). Too much aggravation and not enough pay. And like my other buddy, Judge Amy Pellman, they knew their stuff and could lay the law down like an old tile setter, yup, when they were done it was always just perfect, may not have been pretty, but it was perfect every time.

Call me crazy, but was I surprised at today’s ruling in Division 112 of the Van Nuys Criminal Courts? Not at all, Vahagn Jurian aka “the little guy“ is being held to answer by Judge Karen J. Nudell, it is trial time.

Guessing here again, maybe $ 100,000 for a murder trial, Mr. Kessel? Trials are costly adventures into the unknown, sure it is just terrible to retain lawyers and then you sit and wonder. You wonder about all kinds of things, such as, will I need to hire more lawyers? Well I swear I could hear Connie Francis singing, “Who’s Sorry Now,” one of America’s great singers from days gone by.

Mr. Kessel did an incredible job in his defense of Jurian, sure if this was a case of hit and run and it was not the ultimate criminal act, the act of murder. Not to say Kessel did not do his job, he did and did it well. I, as well as others were never sure in what direction lady justice was blowing, my thought, “murder” — someone has to pay. Deputy D.A. Nison is like a fine wine, you take sips and enjoy the flavor, the body and the next thing you know you are walking funny. Nison is one of the District Attorney’s star performers and what we sat and listened to the last couple of weeks is only a warm up. And that big guy with no neck and no sense of humor, Detective Thomas Townsend, Homicide…I am not sure who would be worse, Detective Townsend or Marty Singer to have on your back…I would choose neither of them.

Is it my opinion others are going to be arrested, and not just the obvious one. My thoughts are there should be more arrests, could be at least 4 more? Again just me thinking out loud and sheer speculation. For sure, perhaps not for the murder of Mike Yepremyan. The California Penal Code has section upon section of great material (other than 187 PC) that has not been used yet when people are murdered. The sections and the wording are as tricky almost as much as all the participants in this case (again I am thinking like an old x copper here). Remember. I said earlier that if it was me I would keep some bail money for that rainy day, and it was beginning to “drizzle” today in Van Nuys and in surrounding communities.

Here is some free advice, in every murder case or for that matter any major criminal case there is a “window of opportunity.” When I covered the Anthony Pellicano prosecution, one of his codefendants, Arneson, could have cooperated and got a lighter sentence or who knows what he could have gotten. Arenson was a little cocky, as if he knew better than anyone else. Then there came a time I could tell he wished that he had been a little more forthcoming with the Feds and Cops. You know what I mean, a “coming to Jesus” moment, when you realize that you are going down like China Town. And it does not have to happen…10, 15 ,20 years in “the joint” is a long time. If someone close to me was in this position of looking at serious time for murder? I would be sitting in the lobby of the North Hollywood Division wanting to speak to Detective Thomas Townsend, Homicide…or in other words, having a “coming to Jesus” moment.

“Liar Liar Big Fat Liar” — this is very often the tone and rhythm that many “difficult” divorces take, it is truly a “liars club” and if you are victim of a great liar you are in big trouble. It can take on all kinds of lunatic behavior: falling down and blaming the soon-to-be Ex, cops come and hall his ass away. It had to be him right? Wrong, it was a set up, a little pay back for coming home late. Drop a .38 or .45 in the handbag of the soon to be ex-wifee and watch her get detained at the airport, damn x-ray machine! All I am saying, I have seen and watched this stuff for almost 20 years. And don’t even get me started on the “spaghetti escapades.”

A case at hand is one featured in this Los Angeles Times two-parter investigated and written by Christopher Goffard, a sad story and yet with incredible luck. The condensed version of the events are terrible in even short form. Child custody, the fertile fields of all the molestation allegations and drug usage and all the other horrible things one side can conjure up against the other. Keeping in mind these people up until this time were lovers and partners and in some cases even married. Now they are mortal combatants in the land of hate and divorce. It will be the ultimate decision of the judge who has to figure out who is the biggest “Liar.”

Sexual molestation of the kids, your kids, neighbor’s kids, the kids at church, kids at camp even the family pets are not safe in the world of a vicious DIVORCE…the judges that I know and talk to find it not entertaining and a terrible waste of the courts time and resources as these accusations have to be investigated and most of the time they are false, my experience. BUT, look at one side or the other did to the other, a mess and an awful experience to go through and even being innocent can still leave a cloud over your entire life for years to come.

Goffard’s story is about a man named Louis Gonzalez III and his former girlfriend Tracy West and a little boy they shared together and a custody issue in Ventura County, California. Well one day Tracy West calls the cops and tells of being tied up, sexually assaulted, beaten, and suffocated and the person she said that did this? Louis Gonzalez III. Lucky for Gonzalez, the police detective David Del Marto began to realize something. That something was that the facts as given to him by Ms. West did not make any sense. Det. Del Marto went to great lengths to see what if any of this was possible and the more he looked and reviewed video at the airport, bank and bagel shop none of it made any sense. Gonzales could not have done all of this in the time span that it took place. Worst of all was that Louis Gonzalez was sitting in jail and it was appearing he was getting framed (my words).

It would come to pass that the accusations did not make any sense at all and Louis Gonzalez would be released and get his entire record cleared. By court order he would be found by the same judge that would have presided over his trial, Judge Patricia Murphy issued an order declaring Louis Gonzalez “factually innocent.” This was a wonderful and life changing event seeing what the charges could have done to his future, not easy being arrested for such a serious crime.

Mr. Gonzalez had two big things in his favor: a police detective who went with his gut and training, and a judge that also saw through the entire attempt to “frame” an innocent man. Det. Del Marto found the truth, good job Detective Del Marto, you served justice on this one. Too bad you did not have a set of cuffs for Ms. West.

Fans, I only wish this was a fluke in the world of divorce & child custody. What I am about to say is that it is this investigator’s opinion that this behavior is more common than you would care to imagine. Certainly this is an extreme example — does this often happen to this degree of criminal behavior? Not quite but it still can be bad. All I am saying is that when it comes to divorce, evil and vengeance are alive and well. As I have said many times, for Nazarian and Associates it is about winning, that is what we are paid to do. However, if asked to frame someone we would walk and did just that recently on an assignment, third time in 20 years.

Anyone who finds themselves in such a tough position has only a few hopes and a very short “Hail Mary.” That being cops doing good police work and a judge that can see what is going on and hear the truth. The truth in divorce cases and even criminal cases is not always found and the results can be devastating. I cannot tell you the number of times over the years that I had to politely mention to a uniformed law enforcement officer or a detective that what they were investigating stems from the book of dirty tricks aka DIVORCE. And once they realize that they are being played by one side or the other it is an awakening…and if I were not there to mention these facts? A whole different chain of events could change someone’s life just like what almost happened to Louis Gonzalez. We wish Mr. Gonzales all the best in the years ahead with his son and for Ms. West? SHAME ON YOU FOR WHAT YOU DID, SHAME.

Go to Central Casting and tell them, “I need someone who looks like a judge, and he needs to look elderly.” Guess what? the guy you are looking for is in Dept. 43 down at the “Stanley.” Over the last few weeks I have heard different opinions on the “new” judge that took Judge Rafael Ongkeko’s place. Being perfectly honest here folks, Judge Ongkeko was not the most popular judge among the city’s divorce lawyers. Many — not all — would pass on having Ongkeko hear a case. Judge Ongkeko had a personality that was a little tough to understand, I have had that very same problem over the years. Should I say that maybe criminal courts in Van Nuys might be more fertile ground for his style and warm personality…just a suggestion (this was the judge that Mel Gibson’s legal team got booted from his case. Under California law, lawyers have 10 days from the filing date to apply for a different judge).

Back to Judge Robert E. Willett, a former litigator for over thirty years with the firm of O’Melveney. Pretty much right out of Berkeley’s Boalt Hall School of Law (1974) he went to work with O’Melveney and remained there up until his appointment by former Governor Schwarzenegger in 2010 to the Superior Court bench. Now I am just guessing that this had to be a BIG pay cut for Judge Willett. For any lawyer to become a judge it is almost a crowning point, the icing on the cake and again, Judge Willett was not making minimum wage as a 30 year litigatior with a firm like O’Melveney (sounds like a good name for a cookie). So let’s not do any fund-raising for the good judge, now some judges who had other positions and not with big firms or founding partners, them maybe.

I spoke to several lawyers prior to visiting Dept. 43 and having a seat. Some that I spoke to had a wait-and-see attitude except for Patrick DeCarolis of Trope and Decarolis. Patrick told me that he got a sense of “quiet power“ and furthermore to make his point even more clearly, “I like him.” Well I sat in the front row as I often do and watched and listened as a group of four lawyers attempted to practice law. I immediately saw what Mr. DeCarolis had mentioned, “quiet power,” Judge Willett is not going to wring his hands and I don’t see him sitting on his hands and rocking either, he has been around and in far more difficult positions as a litigator than he will be in the position he holds now. My point is that I think we have a new judge who once he gets his footing is going to be one of our favorites at DesperateExes.com.

Sure he has that smile and glint in his eye, more likely he has that even when he is pissed, you know what I mean? Beverly Hills is the place all the big names in divorce are moving to little by little and step by step. One of the most recent arrivals to open a new office in Beverly Hills is none other than Robert M. Cohen, Lawyer. Mr. Cohen has been in Century City for many years, I might even say for “ever.” Moving to Beverly Hills is what I think was brilliant (Joan’s idea?), enough of those stuffy towers. Mr. Cohen has always been one of the premier sole practitioners in the world of divorce and now he is right were he should be, Beverly Hills.

The new digs are incredible, smooth and elegant (Joan’s hand?). Mr. Cohen keeps a substantial support staff to assist and I have to think they are thrilled, too. And if they are not thrilled? Who cares, as long as Mr. Cohen is happy and he and I can have great lunch spots. This office is close to some incredible eats, walking-distance close. Anyone who has ever had an office in Century City has to have at times dreamed of getting out of those towers. And parking? Forget about it, lots of cash to park in Century City. For me, I love parking in Beverly Hills as my Bentley does not stick out as Bentley’s line up to make left turns and public parking is cheap and well-managed.
