I have to wonder every time I visit the Stanley Mosk Courthouse and listen to what takes place in the DIVORCE court departments. Not everything is peachy at all times in all the departments…trust me! Things were not “peachy” for one lawyer and the story follows!

Lisa Helfend Meyer had an interesting encounter with Commissioner James Endman who “nests” comfortably in Dept.84. What became obvious was when Commissioner Endman became annoyed as to what appeared to me was his inability to understand the facts as they were presented to him (it was an international issue), he was done! Commissioner Endman would leave the bench in what could only be described as a “huff” and as he exited his courtroom for his chambers he did very much resemble “Grumpy,” one of the 7 Dwarfs!

All these years as a commissioner and having to deal with the same stuff as all the other judges and commissioners have to deal with I am sure it takes its toll. It takes its toll on me and I am only an observer. I am here to tell you Judge Endman and Lisa Helfend Meyer won’t be making “latkes” any time soon!

Talking about grumps, on the morning of December 15, 2011 I was in the courtroom of Judge Christine Byrd, dept. 65 and who do I see! Sticey Flips aka Stacy Phillips and on the other side is lawyer Laurence R. Goldman representing Freid and Goldsman, he is a partner! Once again I have to wonder where do “high dollar” lawyers buy their clothes? Mr. Goldman was explaining to the court that Manley Freid was flat on his back with Bell’s Palsy (this is a paralysis of the face due to inflammation or trauma of the facial nerve. Certainly it is not caused by laughing too much!) Mr. Goldman explained that Mr. Fried was unable to speak clearly and was partially paralyzed on the left side of his face. All of this bantering was for Judge Byrd to order a continuance due to Mr. Fried’s illness. I am sure that you don’t get this disease by laughing and being warm and friendly.

This could have very well been a meeting of the “worst dressed,” Sticey Flips was wearing an attractive all black outfit and looked pretty good! I could not understand however the several bright neon ‘sticky notes’ stuck on Ms. Flips black handbag? Nice, ever heard of a nice note book or binder? Again, having those bright colors on your black handbag will certainly remind you. I was also confused as to why she was wearing such an odd looking hat while in court? Does she not know better? Then I realized that it was not a hat at all but just her hair, and please forgive me my eyes are not as good as they once were and quite frankly other issues too are not working as well as they once did. May I suggest Jose Eber, and he too wears a hat!

Further down the hall I see Mr. Kolodny looking as good as ever and again a more entertaining and delightful fellow to speak with cannot be found. A great story teller and always great to speak with.

PS: For all of you who may or may not have been ticketed by “The Monster,” if you are lucky enough to drive a Sheriff’s white service car you can park in the red zone and not worry about being ticketed…as I have always said we are not created equal.

This is a short one, something all of the media reporting on the Kobe and Vanessa filing for DIVORCE missed and missed big time was “the plan.” There is not a question in my mind that Ms. Vanessa had to have been counseled to stay married to Kobe for the full ten years. No prenup, ten years plus is the magic number to assure that you get it all…well, half. That ten year marriage mark is critical in any BIG DIVORCE and I am not buying that it was just happenstance that when 10.6 years was hit it was “get my phone and call me a DIVORCE lawyer.”

DESPERATEXES.com congratulates Vanessa Bryant, well-executed plan, you made it to the 10 year mark and now you get half of everything and all you can carry. You go girl! Kobe, I have to wonder if Vanessa ever really got over that little incident at the hotel in Colorado. Oh I know, not guilty, but the little missus was doing some planning too! Kobe, I am not sure if anyone has had the heart to tell you, but you got played and played big time.

Only question is how did Vanessa Bryant settle on those DIVORCE lawyers, hmmm there is much better talent out there and smarter too! Enjoy the fruits of the plan, good job and you deserve all you get. Enjoy your new life without Kobe, I am thinking it is going to be easy, it has been a very long wait for the “special number,” 10!

Eating out at anytime for me is a total act of faith, several weeks ago we had dinner at Mastros SteakHouse in Beverly Hills and it was nothing short of painful. The noise and the crowd were causing me to become ill and I could not wait to get out of the place. I am not impressed with high prices and 80 dollar steaks, not at all. And I am so not happy with starch in my boxers and high end gyp joints. Good food and a relaxing place to sit and talk, I think I found a winner and it is all “Peachy.”

Now to my lunch today, the complete opposite, once again in Beverly Hills and I was with Ira Friedman and his son David. I will never not tell the truth when it comes to great people and even better company. This lunch is not getting any better unless I have a twin that will show up to join me. Now the best part, the place, the restaurant, “The Place.” PICI pronounced “Peachy,” cool right? I was not so sure at first, it was the name had me wondering. With Ira I was preparing for some good food and maybe a drag show with a host named “Peaches.” Once we sat down, Ira and I had a wonderful conversation about numerous things, Ira is funny — if you have never sat and talked to him he is one of the funniest people I have ever met. And his take on “Canadians” will also have you rolling on the floor.

Well when we walk in and are barely in the door, we are immediately greeted by Jason Harley, the owner /chef. This guy is the real deal and the room was wonderfully fresh and airy, white table cloths, the wait staff were right on point. CLEAN! The kitchen well-lit and looking and smelling like a kitchen. The menu was perfect and for me the appropriate level of sound, I have found a place of peace. The ice tea was served in a nice glass and it was real ice tea, not that silly flavored crap lots of places are trying to impress people with (this is important to me). The menu was fresh with salads and a few meats and fish, all of it fresh and a better presentation you cannot find, nice. Ira asks for a “sandwich”, no sandwiches are on the menu today. Jason offers to make Ira his Chicken Parm sandwich (Ira had one last week and wanted another one). What the heck I will have one too…when the sandwiches arrive they are the best, tasty and the bread fresh and crusty, just the right cheese and the sauce, nice again. The side salad is fresh and you can tell it was made by someone who was paying attention to freshness and the dressing was perfect.

David, Ira’s son asked for a pizza with “lemon grass,” when it comes it was the best, Jason tells us it brings him back to his Brooklyn roots (lemon grass on pizza?) I am from Boston and this takes me back a few steps…I taste it, it is good, real good). This place is going to be my new favorite place in Beverly Hills…reasonable prices, fresh food and an owner (Jason Harley) and a staff that cares. After speaking to Jason and others it was apparent that this is just how Jason Harley rolls.

My People, if you don’t like your meal and can’t get any satisfaction send me an e-mail and I will pay for your dinner…this is a safe bet for me! Easy Money for California monitors

Judge Silverman what a mistake you made! Last summer a “monitor” was appointed by the court (you) and the behavior and activity of these monitors is just the worst! I have to wonder what is on the court’s mind to allow a “monitor” to stay in a mansion in Encino? And to live the “Life of Riley,” how I ask is this going to be impartial on any level??? Along with living “fat,” the “impartial monitor” is getting paid all this money, staying in the house, having access to everything that a wealthy basketball player can provide, she must have felt like a firefighter, sure getting paid while she slept. And a private chef to provide meals for the family…LMAO, oh for sure “lots of impartiality“, please!

And then have the ability to travel all over the city and god only knows where else with this very wealthy basketball player and of course the baby! A thought: Why not have them work in shifts, so as to keep everyone honest, to have one person almost move in and live such a lavish lifestyle under the pretense of watching the child is a total crock. This is a total conflict of interest and any touch of reality or impartiality of a situation is thrown out the window. Just like Judges and cops, when I was a cop you could not take stuff for free and judges don’t accept gifts…but take the 6 hour monitor test and get lots of free stuff and perks too!!

At one point this monitor told the mom, “Don’t worry I will be your eyes and ears,” HUH! It was a total stooge routine, mom got her ears pulled and poked in the eye by this “impartial monitor”. Keep in mind, this monitor was staying at the mansion for two to three days a week for a month….CHA CHING!!! Just another financial windfall to the “impartial” monitor. There was a time when ‘Lacey’ came to relieve the “owner-monitor-her boss” and ‘Lacey’ told the mom that this was all a big act (but to someone who has never lived like a rock star this was just a dream come true)…but that she could not cross her boss and say anything (Lacey is not the real name I have changed it).

I am getting more calls then I can answer in reference to my experience with monitors. I know when something stinks and I was right again. Even worse yet, someone called and told “mom,” ‘you have got to get rid of her (the court appointed monitor) she is talking real bad about you’…these “impartial” monitors get to write reports.

THIS WHOLE ISSUE SHOULD BE INVESTIGATED BY EITHER THE DISTRICT ATTORNEY OR THE CITY ATTORNEY…someone needs to get this scam under control. To all the judges in family law courts you need to pay attention here. It does appear to me that the judges in some of these divorce cases are being totally hood-winked and moms and dads are getting screwed!

My advice to all of my readers, listeners and clients is to NEVER TALK to MONITORS ALONE and ALWAYS have someone present to witness and to listen to what is being said. My client had to park her SUV on a busy street as “dad” would not let her pull into the driveway to put the baby in the car seat…wanna bet that never got put into any report…

Ros Soudry

I am fortunate to have several lawyers who I work with and who are true friends. Not the ones who are what I was taught as a younger man “fair weather” acquaintances…as we grow older we understand how important knowing the difference is. And have I learned this working in the world of divorce, and those involved in making it happen.

One of those people is of course Roslyn “Ros” Soudry, Ros has been a wonderful friend and a fun person to go places with and do things, she and her family are the best. Well as we have done many times in the past, I and my sons were invited to celebrate Shabbat at her wonderful home with her husband. What we love the most is the reading of prayers in Hebrew and of course the traditions that we are allowed to share with Ros and her wonderful husband. These are the very traditions that keep people grounded and real…Ros is as real as they come and she shares all of this with myself and my family.

Friendship like this is beyond special, and for myself to have my sons experience the traditions of Judaism is a wonderful experience. Sure, “Tradition,” I am channeling Zero Mostel. The food is all prepared fresh and the wine is always at the highest possible standards. As some of you may or may not know, Ros is an avid gardener and often at dinner we get to sample her harvest during the meal…as I stated, grounded!

Ros Soudry is also a huge supporter of all troops fighting overseas and contributes loads and loads of goodies to help sustain our troops in the field. Politically she is always up on the most current issues that could affect Israel and knows the political lay of the land. Besides being one hell of a lawyer, she is above all else a friend and someone who is always good for a laugh…having lunch at a Century City eatery was almost a riot when it came to ordering and then getting what we ordered. I wish I had her with us when we were in France, she is fluent in French, Hebrew and of course English.

Back on February 27, 2011 my good friend Victoria Kim and Kim Christensen of the Los Angeles Times reported that Dr. Joseph Kenan was being investigated for “posting lewd photos of himself on Facebook and allegedly promoting illegal drug use, unprotected sex and male prostitution.”

Ok, I get it and I might even agree with Dr. Kenan on some of these alleged accusations but here is the rub folks, it is as I have been saying all along, these SOB’s think they are so above it all and can make incredible decisions at outrageous fees and they are not fit to sleep with pigs, monitors and minor’s counsels…FOR THE MOST PART!

You see I am again right on target on the problems of divorce in California and I know what I am talking about, twenty years of playing these divorce games under my belt.

And if you think the courts do a bad job of vetting custody evaluators’ qualifications, go look at the “Minors Counsel” gang! LMAO…Oh I almost forgot, “Monitors” are even less watched. Funny no one watches the watchers!

It was reported yesterday that the state medical board was not going to take action against Dr. Kenan, “a complete investigation was performed, including a subject interview. We then retained an expert witness to review the case, which resulted that there was no evidence of professional misconduct”, by a board investigator.

There were concerns that Dr. Kenan was asking for tens of thousands of dollars for developing custody plans for children…certainly not compared to what many of these BIG MONSTER Firms charge…tens of thousands v hundreds of thousands…’no honor amongst thieves,” again does anyone else find humor in all of this?

Interesting, I for one say Bullshit, these licensing agencies cover the asses of many of these doctors like a horse blanket and maybe it is Horseshit that I smell. As an old cop, I have to say where there is a little smoke there has to be a little fire, welcome to the world of divorce in Los Angeles. Dr. Kenan is quoted as saying, “My comments are entirely in jest. In fact, my comments serve to educate the community’s problems through satire.” Just like us here at DesperateExes.com

Go to Central Casting and tell them, “I need someone who looks like a judge, and he needs to look elderly.” Guess what? the guy you are looking for is in Dept. 43 down at the “Stanley.” Over the last few weeks I have heard different opinions on the “new” judge that took Judge Rafael Ongkeko’s place. Being perfectly honest here folks, Judge Ongkeko was not the most popular judge among the city’s divorce lawyers. Many — not all — would pass on having Ongkeko hear a case. Judge Ongkeko had a personality that was a little tough to understand, I have had that very same problem over the years. Should I say that maybe criminal courts in Van Nuys might be more fertile ground for his style and warm personality…just a suggestion (this was the judge that Mel Gibson’s legal team got booted from his case. Under California law, lawyers have 10 days from the filing date to apply for a different judge).

Back to Judge Robert E. Willett, a former litigator for over thirty years with the firm of O’Melveney. Pretty much right out of Berkeley’s Boalt Hall School of Law (1974) he went to work with O’Melveney and remained there up until his appointment by former Governor Schwarzenegger in 2010 to the Superior Court bench. Now I am just guessing that this had to be a BIG pay cut for Judge Willett. For any lawyer to become a judge it is almost a crowning point, the icing on the cake and again, Judge Willett was not making minimum wage as a 30 year litigatior with a firm like O’Melveney (sounds like a good name for a cookie). So let’s not do any fund-raising for the good judge, now some judges who had other positions and not with big firms or founding partners, them maybe.

I spoke to several lawyers prior to visiting Dept. 43 and having a seat. Some that I spoke to had a wait-and-see attitude except for Patrick DeCarolis of Trope and Decarolis. Patrick told me that he got a sense of “quiet power“ and furthermore to make his point even more clearly, “I like him.” Well I sat in the front row as I often do and watched and listened as a group of four lawyers attempted to practice law. I immediately saw what Mr. DeCarolis had mentioned, “quiet power,” Judge Willett is not going to wring his hands and I don’t see him sitting on his hands and rocking either, he has been around and in far more difficult positions as a litigator than he will be in the position he holds now. My point is that I think we have a new judge who once he gets his footing is going to be one of our favorites at DesperateExes.com.

Sure he has that smile and glint in his eye, more likely he has that even when he is pissed, you know what I mean? And it is going to be the job of any lawyer in front of Judge Willett to figure out — is he smiling because I am doing a good job or is he thinking, “moron”! To me that is the best part of Judge Robert E. Willett.

Always the place for interesting stories, the Stanley Mosk Superior Courthouse…and I love this place as you can learn, yup I said it, learn. You will learn what to expect when you decide to pull the trigger and divorce ol’ Useless. That could be either a him or a her, most often it is him but sometimes her. As I have often stated and believe with all my heart, by sitting and listening in the courtrooms here, you will hear what you should and should not say.

Today in Department 88, Judge Gordon’s court, I stumbled in and a few moments later the Wayans case was called. Damon Wayans Jr. was there as well as Aja Metoyer, the mother of one of his children. Aja was with her lawyer, Eric M. Moses, nice address, 1901 Avenue of the Stars, 2nd Floor, Century City, nice. Damon was pro per. Mr. Moses has been in the legal field for 20 years and family law for 5, he should have gone into defending drug dealers and perverts, they pay better! It is my opinion that Mr. Moses was attempting to do a couple of things. My initial piece on this was a little rough on Mr. Moses. The judge advised him that he had the wrong sections filed for what he was asking for and one thing was very outstanding. Mr. Moses wanted to see about getting paid…LMAO! It seems for some divorce lawyers this is no problem at all. Mr. Moses was trying to get paid and he is entitled and it is the rule, that he/she who has the money has to pay. Is this fair, I don’t think it is always but at times it is needed, litigation is costly. My advice to Mr. Moses, get some money up front…it might be all you will see.

Ms. Metoyer made a fatal mistake when she put her mouth in gear and left her brain in neutral. She clearly stated “My child,” people, it is always “Our Child,” no matter how jealous you are and how much you cannot stand the new “Mrs.”, keep it real, it is always about the children and not you, the jealous hateful parent. Mr. Moses should have given his client a heads up as to what is appropriate and what is not good to say. This misstep is often a clue to the court that there is a problem. A problem that is being channeled to the children in an attempt to alienate one parent towards the other. All in front of her lawyer…I do feel that Mr. Moses should have had a lid in his hand to cover her pie hole as I could tell that she is one of those who need “mouth control.” What Damon Wayans Jr. was asking for was reasonable and fair, and he came across clear as a bell and likable. Ms. Metoyer was also likable in her own way, but she also came across as still feeling very jilted and very jealous towards Mr. Wayans’ new family and his kids from that relationship. Then came the cheap shots from Mr. Moses in trying to salvage what was a bad day in court for him. When I say a bad day in court, Mr. Moses and I spoke recently and he explained to me the difficulty he was having and was on board to make sure that Mr. Wayans has a place in the children’s lives, and I believe him. And folks, I believe what he was telling me.

Speaking for his client and trying to do her bidding, it was stated that when the children stay with Mr. Wayans they are not fed, they don’t do homework and they don’t bathe…I say BS. It sounded juvenile and worst of all a cheap shot. Judge Gordon warned the parties that if they continued to throw accusations around that “third parties” would have to get involved. That would mean evaluators, psychologists, minors counselors and a gaggle of misfits that would work up some bills that will make you wish you never made those silly accusations in court. Folks, to some degree this is a vicious game, and being cute and cutthroat will only work against you and your wallet. Note: Lawyers throwing “cheap” shots is also a BIG part of the game.

Again Mr. Moses made a plea to the court for money aka “support,” and made an interesting comment that his client “has not worked in years”…about time girlfriend finds a career. Damon Wayans, Jr. has been paying and being as fair as he can be, my opinion. Then Judge Gordon made it clear what that was going to be and that too is a very ugly time for the person paying. Again, keep it real or one of these bench officers is going to make it real, very real. My advice to both of these people, Mr. Wayans you did good today, Ms. Metoyer you did terrible today and after a closer look, it was your fault. As I stated above, your lawyer should have had a lid or been able to pull the plug to keep you quiet. I for one think that if you bury the hatchet and think clearly of where you want to be at some point, speaking for yourself would be the way to go. But after a second thought, I think your speaking for yourself is not an option, KEEP MOSES!

Michael Trope has hit the grand slam home run of Family Law. He hit the ball right out of the park with the bases loaded for his client, Lisa Kerkorian. We at DesperateExes.com are betting that this is one of the biggest if not THE biggest child support wins in the history of divorce in the United States of America. As many of you will remember, Lisa Kerkorian was almost like the Rodney Dangerfield of DesperateExes, this was bad for her and so many people had stuck a fork in her and decided that she was done…but Lisa K is no fool, she reached out and picked a winner, Michael Trope, of Trope and DeCarolis.

Michael Trope not only negotiated this incredible win — $100,000 a month until her daughter is of a certain age and no longer living at home, when it drops back to a mere $50,000/mo — but folks wait till you hear this number: $10,250,000.00 in retroactive child support for Lisa Da K going back to 2002! There is no other lawyer in the United States that could have put a deal like this together, none. Millions in “retroactive child support”??? Who has ever heard of a number like this? $10,250,000 in retro what? Ms. Kerkorian has had a lot of lawyers in the past years and most fell flat on their faces when it came to getting her the real “Cha Ching.” Sure, they got paid barrels full of money, however Lisa got the short end of the stick each and every time, can you say “vindicated?” Whoever found Michael Trope for Ms. Kerkorian should be awarded a trip around the world, all expenses paid!!! Or a Rolex, “The Yacht-Master II” blue bezel and white face, that is a 43mm case, very nice! This is as big as it is going to ever get in the world of divorce aka Family Law and it was Michael Trope leading the charge through all the previous wreckage, the work of all of the other lawyers.

Folks there is always a backside to these stories and this one is no different. It was back in 12.1.2008 when Michael Trope presented his “Motion to set aside” all the nasty stuff that victimized Lisa Kerkorian. As some of you will remember when she had Kolodny and Anteau as her lawyers pretty much all of what she said on the phone was being shared with Kirk Kerkorian’s lawyer Christensen and only god and Anthony Pellicano know who else through wiretaps, and we all remember what a nasty bit of business that was and Terry Christensen lost his ability to practice law…disbarred.

Well read this:

1. Lisa did not get a fair trial in 2002 because her lawyers were compromised with wire taps….and that is not fair and not legal, just ask poor Terry Christensen.

2. Michael Trope was asking that everything be set aside as it was an “unfair” trial. And this was the only reasonable thing the court could do…a great position to take.

3. All previous evidence would have to be purged, tossed, thrown out, dumped…why? It was all obtained through illegal conduct…makes sense…”hello is that you?”

4. And that if the trial was to go forward, the Kirk Kerkorian crew would not be allowed to present any new evidence and all of the other stuff would be tossed…so no evidence would be presented…interesting thought.

5. And that Lisa Kerkorian be granted a default of $323,000.00 a month, all the way back to January 2002…cha ching! Not a big cha ching, but a cha ching!

Now if the judge would go along with that program, lets do the math, $323,000 minus the $50,000 a month brings us working class fools to $277,000 a month x 102 months for a grand total of $28,254,000. Now that is some exposure, and I am not talking warm and fuzzy kind for Mr. Kerkorian!

Now, for the big turn, a change of direction, we got a fresh attitude. I wrote on May 12, 2010 that the Judge orders lotsa bacon for Lisa Da K lawyers.” That day, it is my opinion that Joe Mannis, not being anyone’s fool saw what the exposure could be for his client and began to chart a new course. The actions and comments that day by Judge Steinberg made it clear that it was not going to be business as usual when it came to Lisa Kerkorian and her lawyer, Michael Trope. The other side representing Kirk Kerkorian had committed serious crimes and this Judge was not going to be ignoring the behavior. In many ways it was as if Michael Trope had slapped lipstick on a pig and someone on the other side of the table walked out of the courthouse with lipstick on their collar.

The deal has been floating around it looks like since July 8, 2010, my birthday! The agreement was finalized and signed just today, October 22, 2010. Representing Mr. Kirk Kerkorian is none other than one of the biggest hitters in family law, Joe Mannis. When it comes to seasoned lawyers talk to Joe Mannis. Keep in mind, Mannis represented one of the richest men in the world on this divorce/support issue. Talk about Titans of DIVORCE, here you have two of the best in the game, Michael Trope and Joe Mannis!

In closing, this was some of the best big gun lawyering in Family Law court this year, Michael Trope for Lisa Kerkorian and Joe Mannis for Kirk Kerkorian. Joe Mannis heard the court and made all of the right decisions and in doing so, clearly in my opinion saved his client millions of dollars. And for Michael Trope, need I remind everyone that before becoming a lawyer, he was one of the biggest sports agents in the country…”The Art of Negotiating” is alive and well at Trope and DeCarolis.
