No xmas for Anna's "heir(s)"

Well talk about “the other shoe dropping,” it did for a few people this morning. I am sure that anything to do with the “Supremes” will never be a favorite group for those left behind in the Anna Nicole Smith saga, for that matter they may never mention “Supreme” anything. The cascading and never-ending grief that surrounded Anna Nicole Smith just continued today when the U.S. Supreme Court made it clear, “Get a Job.” There will be no millions and millions and for that matter there will be Zilch, Nada and all those legal fees..ouch! The dreams of all those “Benjamins” stacked neatly in big piles and personal bankers have all turned into nightmares, just like the lives of many involved in the Anna Nicole Smith Saga.

It is my belief that had Anna Nicole Smith lived, life would have been better for some and just awful for one or two. The “Master Plan” would have been in effect and she and her constant companion would have lived happily ever after raising “their child.” Perhaps I think that the U.S. Supreme Court would have maybe been a little more generous had Anna been around. What “The Supremes” thought of this case and the “players” was addressed by Justice Roberts. The comment by Justice Roberts in quoting Charles Dickens novel “ Bleak House “ spoke volumes with what he was thinking in reference to this entire matter, again, my opinion.

Someone told me that they thought that they heard someone yell, “Oh my god stop decorating,” we are not sure in what context that was heard, but funny right? All those millions would have been a pain in the ass for someone to have to handle, just terrible. And the lifestyle, Big Houses, Big Pools, Big Lawns, Big Staffs, Big Security, Fancy Cars, First Class travel, Wonderful Fancy Hotels the “Life of Riley.” Who the hell would want such a thing to have to wake up to every morning, knowing that all you had to do was have fun with your kids. And spend money taking “care” of all their little needs each and every one of them. Looking at what money and fame has brought to the life of Anna Nicole Smith, maybe the simple life will be the trick and one of joy and love. Frankly, what the hell, seems like there is not much of a choice at this point…

Many times I’ve stated, the real truth of the Anna Nicole Smith case will never be told, at least in a court of law. Howard K. Stern had his entire case thrown out by superior court Judge Robert Perry, this judge made it clear from the very beginning he did not like this case. And in the end he made it even clearer by taking the action that he did.

Dr. Khristine Eroshevich also escaped with her title intact – Doctor – when Judge Perry commuted her sentence to 12 months of probation and a $100 fine. That made it crystal clear what he thought of Mr. District Attorney. Dr. Eroshevich and I were to write a book of the “real” Anna Nicole Smith and the shenanigans that were being pulled on and around her. There is still not a question in my mind having discussed this in detail with Eroshevich that it would be “her” telling the story of what she saw that would be a bestseller.

Again as I stated previously, the D.A.’s office did not expect to have to deal with Steve Sadow and what I called the “Sadow Factor.” In the beginning who ever heard of this guy? As I listened and watched I could see what an incredible talent he had with the judges. Both judges Westley and Perry, it seemed to me that they channeled their thoughts and had a clear understanding of what was needed and what to focus on. The other lawyers were pretty much following his lead.

No matter what we or I think it is of little difference, the Three Stooges were arrested and charged and played the prosecutor’s game and in the end all three won their freedom. Their reputations will be forever in question, just as was O.J. Simpson, most thought he was guilty of the crimes he was charged with…the difference was that the jury set him free and in this case it was Judge Perry who set Howard and Bubbles free. The common thread is it makes little difference as to actual guilt. The Judge saw through what was being done and did not like it, and I agree. I agree with the law as this is what our country is based on. My problem is all those conversations I had with Eroshevich and all the discovery that I read, and every lie has a little truth.

Let me put it this way, what the Los Angeles District Attorney did was try to bake a cake. Yes, try and bake a cake when you had no flour and the eggs were rotten, so bad that even realizing what you were doing was not on target and the cake was going to stink. And stink it did, this has to be one of the biggest stinkers the L.A. District Attorney has had to face during Steve Cooley’s time in office…hundreds of thousands spent and you could not even get anyone to eat your cake!

Having a judge who is annoyed with the case as charged and who would become even more annoyed at Prosecutor Rene Rose who was prosecuting the case was another element. There was the Sadow Factor and the other element was surrounding yourself (Howard and Anna) with people who at their best were incompetent. We saw the body guard, the wife of the body guard, the nannies (and their families), star-struck government officials, real estate moguls/felons and a galaxy of hangers-on, and it would be their very testimony that would be almost as comical as an episode of the “Anna Nicole Show”…the only thing missing was that flamboyant fruit cake. It was this very, very incompetent and annoying testimony that further pissed off Judge Perry.

In the end Howard never looked better, and Bubbles had that annoying grin still stuck on her face, and even Kapoor showed up for some face time. You would have thought he would have avoided the Criminal Courts Building at all costs – ahhh, the cameras (I certainly can relate to that). And we should all be happy for them, much of this was a mistake from the beginning on the part of the investigative agencies who participated. From the Bahamas to the United States, it was clowns with badges and guns. And personally it is my opinion some would not have recognized a crime scene if their lives depended on it, screw-ups and star-struck they were. And it was a horrible thing for anyone to go through, not knowing if you are going to be free or in some lockup for a few years. On the other hand, it was their own behavior that got them to this point sitting and wondering what would become of their lives, doctors and lawyers oh my. Let us not forget, two young, beautiful people under their watch and care who should be alive and well are dead and gone. And like one of those airplane kits you buy online and then build it yourself and fly out of the blue skies and crash to earth, well, the best laid plans of mice and stooges…

Not that I am going to be sharing a sandwich at Nate & Als with any of the three but with the luck this bunch has, the California Lottery should be their next stop.

Numerous people have asked if I had a comment or thought on “the verdicts.” That afternoon I was on my way to New York for an assignment with one of my sons. I had the driver put the limo’s radio on the local news and heard the verdicts. Funny, the day before Dr. Bubbles was reported to be in a state of tears and Howard was comforting her…I was not sure if that was a “hug” or a “head lock,” either would have been appropriate…one more than the other, LOL

(Let me cover a little issue, there have been alleged statements from “the horses ass” that I was fired by Dr. Bubbles…NEVER was I fired by anyone involved in this case! Anyone who can show me proof in writing that I was ever “fired,” I will pay them $5,000…so be sure you are not talking to “the horses ass” as “she” has caused a great deal of damage and continues to…and as I warned, “Let sleeping dogs sleep.” Or I promise, there will be tears enough to fill a very big pool! Also let me just say this to try and understand my position, reality never hit home with some of these people, and when I feel like I am being lied to or bullshitted I am gone. Be right with me and I will stand at the gates of hell with you, do the other, I will be having a cold drink sitting by a nice cool stream.)

Sure, like many I am surprised that Dr. Fabulous aka Kapoor walked away totally’free…his “acts” of hiding the files and then trying to re-write the files were suspicious. Was I the only one that thought this behavior was curious, I am sure the investigators did, and how about you? Another thought on Dr. Fab…he does come across as likable, a little vulnerable, a little feminine and the jury I think liked that. He also had a great lawyer, a woman with an interesting presence in a courtroom. It all worked for them.

Dr. Bubbles Eroshevich I believe never made any money in this adventure that she pursued with much gusto and energy to be in the “in crowd.” I have been told that she was paid for interviews during the “fun times” right after Anna Nicole Smith’s death. However, I have never heard of her actually making any money. If true she is the only one who did not make hundreds of thousands of dollars, THE only one. My other thought is that she came across as arrogant and not likable during the trial, smiling or those silly gigles at inappropriate times…simple, she does not come across as likable. I told Dr. Eroshevich of my concerns and that I felt that her license was in serious jeopardy. For reasons that will remain quiet, Dr. Eroshevich had choices, unfortunately she chose the wrong door. Now for some of you out there in the land of “horses asses,” you know nothing, zilch, less than zero about any of this. The evidence was not always 100% but keep in mind, in every lie there is a little truth. And something did happen, got it? good, get it!

For Howard, again, one of the smartest guys I have ever met, he thinks and rethinks and thinks some more. Is he a control freak? as much as he is brilliant and people with that characteristic can create havoc in their lives. Why? You can certainly be clever and manipulate and play the game of “he said she said” to keep everyone off balance. What I mean here is this, you are a part of the “crowd,” you think that you are liked and trusted, then one day you go from “good guy” to “bad guy.” You wait a few days and BAM you are a good guy again. With the money Anna had, a real nurse could have been hired, a real body guard could have been hired, but someone hired two clowns to take care of Anna and why? They were cheap and in the end it was the incompetence that set all of this into motion. Had a real nurse, someone would have been physically checking Anna…what nurse walks into a room and does not check the patient first thing? NONE that is who, none! Real registry nurses cost money, and could there had been any shenanigans with a real registered nurse I think not…now again, you and the talking horse’s ass, have no idea of the facts, none…there was a great deal of truth in what was said about those dam spoons…”oh no Mr. Bill, tell me it ain’t so”….remember the “tell all,” I do.

Now for all of you who live in the land of fantasy and horse’s asses, this jury took a great deal of time to come to the conclusions that they did. The district attorney is very much aware that they won, they got a conviction and to think that a judge is going to make it all go away? Wake up, it was Judge Perry who was told to “believe in the jury,” well he did and he needs to be careful that he as a bench officer does not insult the jury and the system that he represents. And he has a boss too, and there are going to be a number of people looking at whatever decision he makes. The timing is bad, it is an election year and these defendants are in the middle of it. Steve Sadow I thought had the jury and they were getting it, I was wrong again (on the other hand, it could have been a lot worse and they were cleared on many charges). I still believe that Steve is a great lawyer and as I said before, this is Los Angeles and L.A. juries, well they are L.A. juries!

Well we are all just sitting here waiting for the guilty verdicts on the Anna Nicole Smith trial to come in, and are curious as to what is taking so long? It is now day five of deliberations and nothing from the “Peers”…not sure if it is going to be good or bad…either way, it appears that the jury is taking their time and crossing the T’s and dotting the I’s. And Judge Fidler is not Judge Perry…big difference.

So, a little light humor here while we wait. And while chuckling, pay attention and you will learn something about the way of this world we call “Divorce.”

Folks, here is a little update on the story we did on Mr. Douglas A. Bagby on June 15th of 2010 titled, “The Ted Baxter of the Courtroom”…well, time does change things and in this case it went from awful to just terrible, I mean bad, real bad, like all four of my tires are flat bad, miserably painfully on a scale from 1-10….TEN+ !!! Now keep in mind clients will often turn on their lawyers, this is not unusual. What is “fun” here is that I was fortunate to be there when the “worm began to turn.” I am sure Bagby wished I was off getting a nice massage on June 15th, 2010…but I was not and was sitting and listening.

As luck would have it, Ms. Lauren Stills on September 17, 2010 signed a declaration under the penalty of perjury all of the following. I am going to take snippets of her declaration, the parts that I found “moving” and I am sure that her lawyer Mr. Bagby, too, found his “bowels” wanting to move. Ms. Lauren Stills was the woman whom I stated, “she looked like a horse that had been ridden hard and put away wet!” Well, when you go through her declaration and read what she has to say about her lawyer, Mr. Douglas A. Bagby…I was right: as many women sitting under that saddle have gone through, she had been ridden, real hard.

Here are some highlights:

From Paragraph 3, First Page, of what Lauren Stills’ declaration:

“Mr. Bagby’s seeking to withdraw under the circumstances of my case is, in my view, unconscionable. It should not be granted. Indeed, he seeks to withdraw after depleting a substantial family asset base, the size and limits of which were known by him, as he advised me from the outset and on the eve of my hiring him to sell our family residence to raise funds for legal fees, which only now seems like self-serving advice which helped his practice weather the economic downturn while there appeared an evident client shortage.”

DESPERATEEXES.COM STATES: WOW…I HOPE THERE WAS A BLANKET AND SOME HAY WHEN SHE GOT TO THE BARN.

Paragraph 4, towards the bottom:

“ Quite frankly, I trusted Mr. Bagby, and expected from the outset to the present (minus two months) that he would be faithful in bringing closure to both financial and custody matters given the ample resources he had at his disposal.”

DESPERATEEXES.COM STATES: WOW, Yup, “He had,” that is past tense!

Paragraph 4, bottom:

“It made no sense to spend as if there was a bottomless pit of financial resources, which he knew there were not. Could it be true that Mr. Bagby figured he would just work until the money ran out and then withdraw? Sadly, I now believe this to be so.”

DESPERATEEXES.COM ASKS: Lauren did you ever discuss with Ted Baxter, excuse me, Mr. Douglas A. Bagby your concerns that he was spending too much of your money? If you did not question this then it is sad, for you. This is not unusual at all, and again how many women out there in Divorce Land can relate?

Lauren did you ever mention how nice his suits looked on him? My tailored suits have my name and the date they were made for me…just a thought.

Paragraph 5, first line:

“Over approximately four years of representing me, Mr. Bagby has completed no or virtually no discovery on the most critical financial issue of the entire case–namely, valuation of PIP–and has left the forensic accountant with a balance of over $ 16,000.00 and a payment promise long overdue”

DESPERATEEXES.COM STATES: WOW X 3. Often we as private investigators will assist clients with issues like this and try and “ride herd” over the case…it is almost sounding like there was a stampede of Ben Franklins aka “The Running of the Bills.”

Paragraph 5, line 29:

“The bottom line is that Mr. Bagby has incurred ample fees to ensure payment for himself–to the tune of approximately $1 million in fees to his office over almost four years…”

DESPERATEEXES.COM STATES: Oh that is one hell of a tune, Peggy Lee had a hit recording titled, “Hey Big Spender,“ that too was a recording with a real snappy beat. Lauren, did you ever notice how nice Mr. Douglas A. Bagby’s suits looked? I noticed that he was rather well dressed…not as nice as Sorrell Trope, Lisa H. Meyer or Susan E. Weisner, but nice.

Paragraph 6, line 20, Lauren Stills declares:

“what is going to happen when the money runs out?…Had I been provided just one ounce of an honest answer months and hundreds of thousands of dollars ago, I would have made different choices…” “letting the attorney ‘run the show’…”

DESPERATEEXES.COM STATES: Lauren, you should have paid more attention to the bottom line and had a plan in writing, and always you should have had a bacup plan. “letting the attorney ‘run the show‘’…hmmm not sure I would ever suggest this is the plan to take, without very close monitoring…did you ever ask “why this” or “why that” and how about this, did you ever question the bill and just once say “NO, I am not paying this?”

Folks, read all of this declaration at your leisure as it is a real learning experience for women and sometimes men to realize what you are getting into in the world of Divorce. Is what Lauren Stills experienced so rare? I say no. I have seen dozens and dozens of these situations in the past 19 years. As to Mr. Douglas A. Bagby, I stand by my comments of June 15th, 2010. I am sure I will get the usual comments from Ted and all that goes with that, and if he wants to post a comment we will post one.

As to his “never using my office or services”…good, I am still shopping at Gelsons and loving it. I will never lose sleep over not providing services to Mr. Bagby, personally I am too old to care…and on the other hand, with stuff like this, I could not invent it!

Now in all fairness as I can see the e-mails and letters coming (at least I hope), as I am making it clear now, ANY E-MAILS OR LETTERS FROM MR. DOUGLAS A. BAGBY WILL BE POSTED FOR ALL TO READ ON DESPERATEEXES.COM. This is not to pick on Mr. Douglas A. Bagby, it is however, a lesson for all of our readers that when you are unhappy, DONT SPEND ALMOST ONE MILLION DOLLARS before you speak up! Also I have said hundreds of times that the lawyer – client relationship is great when the money is flowing…and when it stops, BAM! I know of a few lawyers who take retainers knowing already they will not be there at the end…but as Ms. Lauren Stills so well stated, it takes money to keep a practice running. And some lawyers are flying cargo month to month to try and make ends meet…this is not the case of Mr. Douglas A. Bagby, he lasted it would appear almost 4 years.

Mr. Douglas A. Bagby’s declaration as of September 22nd, 2010 highlights forthwith:

Paragraph 2, line 10, Mr. Bagby states:

“I do not intend to provide any response to the many false statements made by Respondent in her declaration unless this court orders me to do so…I do not believe the personal attacks made by the respondent against me do anything other than support my request to withdraw as her attorney in this matter…”

DESPERATEEXES.COM STATES: LMAO! I can close my eyes and hear Mr. Douglas A. Bagby stating his position, standing of course. I agree with Mr. Bagby, it would appear to all who read this that Ms. Stills is not happy, to the tune of about a million times! My question is did she send her complaints to the State Bar of California?

Paragraph 2, line 17, Mr. Bagby states:

“August 4, 2010, I sent Respondent a lengthy confidential email explaining why I could not possibly continue as her attorney of record in the pending action…Financial considerations were not the compelling reason”

DESPERATEEXES.COM STATES: LMAO SOME MORE! Brevity is not one of Mr. Bagby’s strong cards. And where in the list of considerations was “Financial.” (someday I hope I can make one million on one case…)

Paragraph 3, line 20, Mr. Bagby states:

“I have invested extraordinary efforts on behalf of Respondent over the past 4 years.”

DESPERATEEXES.COM STATES: SOMEONE HELP ME I AM ON THE FLOOR….OMG!!!!!!! And what did Lauren Stills invest in you Mr. Bagby?

Paragraph 3, line 22, Mr. Bagby states:

“My office has over 7,000 email communications with Respondent since February of 2008 on virtually every issue, including many on evenings, weekends, and vacations, and probably in excess of 10,000 since I was retained by respondent”

Feel free to read all of Mr. Bagby’s responses to his client’s accusations and again, Mr. Douglas A. Bagby is not the only lawyer who bails on a client. I have done it and again I have seen other lawyers do this also. What makes this interesting is the feel I got the first day that I saw Bagby and Ms. Stills in courtroom…I was “dialed in” and I read it right as if I had a menu in front of me.

To all my readers, remember to ask questions and don’t write big checks, write small ones and keep track. And also remember to have someone on your side if you are too timid to ask the ultimate question: “WHAT THE F*%# ARE YOU DOING?“ I have found that lawyers are good at lawyering and all that goes with that, however, a divorce can be like a very big ship and every ship needs a captain to make big decisions. And over the years Nazarian and Associates has in fact been “the captain” and gave our clients a voice in the direction of their divorce, and in doing so avoided stormy weather and bad seas.

Well I decided to give the Criminal Courts Building a shot yesterday afternoon after spending the previous night and much of my day in Catalina. Catalina is one of my favorite places in the world, we have two good clients with rather incredible boats and I have the keys and their permission to use them anytime.

I misunderstood a friend who told me that Steve Sadow was warming up just prior to lunch and that if I hurried I could catch some of the “Sadow factor.” Best laid plans of mice and men…upon my arrival I was told by one of my eyes and ears that he had started first in the morning, and that I had missed some incredible lawyering…”it was some of the best.“ Sadow was dressed in a very nice black suit and white shirt, the usual court wear. And he was into his “step by miserable step” of trying to dismantle the “people’s” case. The people’s case was presented in Power Point and I was told it was very powerful and made all their points and was nothing short of impressive. Steve Sadow had Chris Smith as his Audio Visual guy, and would say, “Chris put this one up.” Hey Hey Hey, I am just reporting what I saw. I thought Chris did a good job…LMAO, do you remember who the AV kids were at your school?

Sadow would mention Larry Birkhead several times, there was the methadone taken from a bag, in the closet at a hospital and how Birkhead had testified seeing Howard give Anna her methadone. However, unlike the initial testimony when everyone was telling the truth in the Bahamas, this was almost warm and fuzzy…Sadow now told the jury that Birkhead could not remember for sure…it was a warm moment. I almost cried, but I am pretty dry after this week… Sadow went on to say that Anna Nicole Smith had lost
her faith in Cedars and wanted to get out of there and fast. She would leave Cedars and she would go directly back to Dr. Fabulous, aka Kapoor, he too was doing all things right! I almost felt that at the break the lawyers and defendants would hum a few verses of “we shall overcome.” It almost seemed that Steve Sadow was defending Kapoor, and I guess, why not? Can’t make those dam diaries go away, no matter how slow or how fast you talk.

It almost looked like family day, Kapoor’s mother and father were sitting in the front row, and Mrs. Stern and her other son were sitting close by also. These are good people who did a hell of a job raising their kids, one’s a doctor and the other a lawyer. Eroshevich was smiling and picking lint off her lawyer (the light in the tunnel !!!)

One of the highlights of Mr. Sadow’s reviewing the facts was, “Anna was leaving Los Angeles to get rid of Larry Birkhead,” his words not mine. We did at DesperateExes.com speak about the “Bahamian Master Plan.” Mr. Sadow also stated that Anna had gone to South Carolina for three weeks…one must wonder was that to assure that her new house was all taken care of?

It would appear that Steve Sadow was less protective of Dr. Bubbles, aka Dr. Ersohevich, and spoke of her putting the prescriptions in Howard’s name and he not knowing what Anna’s buddy was doing. Again this is my thought on what I heard, if I am mistaking I apologize. And that Howard K. Stern had a good faith belief that what the doctors did was legal and appropriate. Howard is a lawyer, he is no doctor, how should he know what is right or wrong, he trusted the doctors..again, I think this is where this was going. (this was also the feeling from the first day of the indictments).

There was some talk of injectible B-12 and something called “Gamma Globulin that had to be mixed together and then injected into muscle, such as in the Gluteous Maximus, now that is a big muscle and seems to grow bigger as we grow older! No one mentioned whether that mixture was just injected once mixed, or did it have to be ‘cooked’, prior to being injected…again, I am just wondering here folks?

Well it kicks off again in the morning with Steve Sadow finishing up. The jury seemed very attentive and many were taking notes…this is good, three or four people told me that the “PowerPoint” was very very impressive, so keep talking and enunciating Mr. Sadow. In the course of the afternoon, other very insignificant people were mentioned, you know little people, potential headaches sorta people. Are you ready for this? There was mention of some silly candy for a better sexual experience! Better than a few hundred dollar bills? Hell, I will stick with my massages with happy trails or was it happy ending?

$24,386 in travel expenses to bring the two loons from the Bahamas? This has to be one of the funnier aspects of this case, how these two people with little education got one of the biggest District Attorney’s offices in the United States to spring for that kind of money???

“Two years for investigators to ‘UNRAVEL THE PUZZLE’ of the case”… Oh, I have to be careful here, did that include any time in the sun? And how much did that investigation cost the State of California and the District Attorney of Los Angeles? These guys did a great job, I read all of it, some twice, and found their work intensive and on target most of the time. But what they did not see coming, in my opinion, was that the people they were talking to in many cases were as bad or worse than the “suspects,” aka the Stooges they were building the case against…ever build a house of cards?

Early on I was very curious if these special agents and investigators had any idea who these people were, the witnesses and the history they carried to the circus that was developing in the Bahamas. And did these investigators ever understand the “Master Plan”? How much time was spent on that blowhard who was trying to nail me? Or that silly SOB who said that I had “climbed his fence”…such garbage the flies would not eat it, nasty trash.

Whatever happens it won’t make a hill of beans to most of us, and I can see this following the tidy bowl man right on down the crapper where it belongs. It had potential to be a homerun for the DA, unfortunately for them they came to the game with no bat. Two people dead and no hooks to hang anyone on for any of it, file it under “Oh well, we tried.” Pretty incredible stuff, sure all the bloggers have their opinions about many of these people involved and how “wonderful” they are, and how “good” they are, and the interesting part is hard for some to understand that many of these people involved in this case would not empty their bladders if these “fans” were on fire. And if for one minute you question the “financial” aspects of this case and look closely you would be sorely disappointed. Judge Perry has his hand on the flusher and I think that he is going to send this case cascading into the sewer below the Criminal Courts Building here in Los Angeles.

“We believe there were felonies“…what happened to them? Did they fall through the cracks with the rest of this case? You had Dr. Bubbles, Dr. Fabulous and a Lawyer, not exactly the “Bonnie and Clyde” gang here. Oh there were things that the stooges did that were confusing and still are, “files nicely tucked away”…hmmmm and that dam “spoon cooking stuff,” (special wink to my “friend”). Funny stuff as with the “cross dresser” and sooooo much more. And it all is disappearing as fast as a pastrami on rye left too long in front of me. That sound of the flush…

“Two days to prepare for a final arguments”…it is a wonderful thing that we are not in a country that practices Japanese customs, as in when you are so badly disgraced you just disembowel yourself. Rene Rose is, as far as I am concerned, a very talented prosecutor and could never have imagined having Judge Perry glaring at her in the final weeks of such a high profile (yet boring) criminal case. Why one asks? Judge Perry had a problem with this case from the very first day! He did not like the way it was “charged” and pretty much said so.

As for the defense pretty much tossing the duck in the air, why not? (feathered pillows) It is beyond obvious that with the group of misfits that the prosecution brought to testify against the stooges that this case was very much done, real done, beyond done. In the early days I, too, agreed that Howard K. Stern’s charges were, based on the “cards” showing, innocent. All of us were wondering early on how was the prosecutor going to “sanitize” its witnesses? Again, on the “cards” showing, if you read the discovery and the investigator’s notes, you could see much bigger issues involving the behavior of people close to Anna Nicole Smith, could have had legal trouble. That stuff was not filed, and what was filed was nothing short of ridiculous and everyone knew it. Still a little serious those early days, even in knowing, it was winnable…and then with “The Sadow” factor I knew early on things would be good for Howard K. Stern. To the point I am sure that a “deal” was a potential life saver for some, and now look, “No Deal” was needed! It is all going to be good and everyone can get on with their lives and no “tell all”…or will there be? (thank god I took real good notes when I was being offered to work on a “tell all” about the stuff that went on in and around ANS).

Prosecutor Rose had one last ditch effort and that was DOJ Investigator Danny Santiago, and Judge Perry kicked all that to the curb. I enjoyed reading an interview with S/A Santiago when an individual being interviewed was tearing into me, it made for a short read. It was great and I owe S/A Santiago a big thanks, he spelled my name right and I appreciate that! S/A Santiago also realized that this person who was trying to sing like a canary could barely hum.This wanna-be witness was nothing but a gasbag trying to get some face time.

Funnier yet that very same person talking shit about me to S/A Santiago would later ask me for a “letter of recommendation.” Talk about strange and colorful stories and I have wheel barrels full of them when it comes to this case. How about this? Being that I have been termed “The King of Trash,” Howard and I came up with an idea about a reality show called what else, “Trashed.” Sure, some of it was Howard’s thoughts and some of it was mine…after all it is my life’s story, right? The premise would be, well, maybe another day…it was supposedly pitched to Harvey Levin in the days before the stooges were indicted…Harvey did not like the idea and in my thoughts the reason is that it would run interference with TMZ…my thoughts.

I could have sworn I saw Judge Perry in a knife store and he was asking about a “good knife to whittle with,” yes sir, you bethcha, when Judge Perry is done “whittling,” Madam Prosecutor, your preparation for a closing argument could take maybe 10 minutes. And given the temperament of this bench officer, it could even be less! And by the time Judge Perry stops “whittling,” the only thing on that charging document might be just one name, Rene Rose, Prosecutor.

Walking into Judge Perry’s court yesterday, I saw Stephen Sadow questioning Nadine Alexie and doing “the Sadow,” that being asking a question and then glancing at the jury. Nadine was doing pretty good in her responding to his line of questioning, to a point I was surprised, she came across very likable and at times pleasant. Oh I hear it, “she’s a liar,” “she was paid off,” “it is all for an apartment,” my only thought is this, is she a liar? Is she the only one in that room that could be classified a “liar”…I think not!

One lawyer was heard in discussion that was all that aggressive attacking of the “Nanny” maybe working against the defense in regards to the jury? At some point it did appear that the jury was done with this part of the trial and wanted to move on…enough with the “Ninnies!” Ninnies away!

Sadow was focused on the “going into hiding” that Nadine described after being contacted by the media via phone and at her door. On her way to becoming famous. There was mention that Larry King may have called, that would do it for me, “Larry King is on the phone,” go hide. Nadine’s response to that line of questioning seemed real to me, however odd all the “hiding” and game playing and calling it “fear”…hiding from what? And she took her sister, nanny Q, with her, all hiding! Hell, there are people I know that keep in constant contact with “media” to assure that they are around for special times!

Nadine spoke of being let go by Mr. Stern due to HKS’s concerns about “leaks,” what leaks it was not clear. However, by this time, it would appear there were many. Funny thing about having “total control” is that it seldom works. It was that “total control” and manipulation that got everyone in this mess.

Look at what I call the Bahamian Master Plan, and how that plan collapsed when Anna Nicole Smith died. At some time that plan will be thought out clearly…don’t get carried away, it was not a plan of mass destruction. It was a plan for a life that would be lived in the Bahamas with their daughter, the good life, away from the annoyances of the states, California in particular! Is there anything wrong with having a plan to rid yourselves of an “annoyance”? Not at all. Keep in mind the way things would have gone had Anna not died.

Nadine volunteered that she had retained the services of Mr. Bain to be her PR person when she thought that it was all sunny days and telling her story and making loads of money. That was of course till she met “The Gentleman from Georgia.” Now under cross she has told the court that she has not spoken to Mr. Bain for months. I am sure that percentage that was having to be paid was painful for someone. There was some discussion as to the money that was promised by the Los Angeles District Attorney’s office and it was somewhere in the arena of $2000 to $2500, worked out by her husband, Amol.

One of Nadine’s recollections was the feeding of the baby, the issue was not too much formula, 2.5 v 3.0. The reason that was stated in court was that Anna wanted her baby “to be sexy.” You could see the look of disgust on some of the jurors…it was an uncomfortable feeling and even more uncomfortable thought.

Judge Perry was not happy with the idea that Prosecutor Rene Rose wanted to discuss further an affidavit “that the witness never read,” and as he would through much of the morning, denied the request.

Prosecutor Rene Rose wanted to present evidence that was already given to the defense, but with a small change that members of the defense objected to. Judge Perry’s response, “grossly unfair.” Prosecutor Rose once again tried to present the material in a little different way, Judge Perry, “Gross Surprise.” One of the lawyers on the defense stated that some of the pictures were “pornographic.” Judge Perry responds, “Seems late to me Ms. Rose.”

Prosecutor Rose continues and Judge Perry responds from the bench, “I find it a surprise.” On another issue Judge Perry states, “I don’t know and I don’t care,” this was when one of the defense lawyers tried to “help” in reference to the photos. I cannot remember ever seeing a judge as annoyed with a prosecutor as Judge Perry appears to be with Prosecutor Rene Rose. Most of the time during the day Judge Perry had the appearance of someone in pain, and the fist to his cheek did nothing to change my belief that this bench officer is pissed.

The only consistent thing about the Nanny Q and Nanny N is the inconsistencies. The biggest question I have is who thought bringing the “Ninneys” from the Bahamas? Along those same lines did anyone from the DA’s office go and speak to these two people? Now we have nine people, eating three meals plus a day, nine accommodations, and because they are flight risks (my thoughts) there is security assigned to them 24 hours a day! To assure that they don’t get lost on the way to the airport…do they have escorts also? Cha-ching!!! Once again, Judge Perry had it with these Bahamian shenanigans, “yes” “no” “maybe.” He is not putting up with any of it, and when you hear these people speak you feel that there is truth but there is a great deal of “story telling”…nannies love telling stories, do they not? To the little ones so as to fall asleep…it worked, as I almost fell off my bench!

From my personal knowledge and not from any of the stooges, Nanny Q was close factually on some of the issues but again, Judge Perry is not going to allow any “sliders” or “spit balls” in his courtroom. It almost seems to me that the prosecutor knows that what she is asking is “wavy gravy,” but what the hell, ask it! And if one of the three barristers doesn’t catch it or the guy in the black robes misses it, Madam Prosecutor wins. This game is going to be played clean and above board, and this was some great luck for the the stooges and the biggest lucky charm was of course the incredible presence of Steve Sadow, Esq. “The Gentleman from Georgia”…and Judge Perry.

The idea that has to gall the defendants is the costs involved in charging them with what was charged. And what about the costs involved for the defendants, for sure if Kapoor is found not guilty it will assure him to keep his license. Perhaps someone from the medical board will shake a finger at him, but his practice? The type of medicine he practices I am not sure if his patients care what his background is. Eroshevich, she is old and will at least have her licenses intact and will be able to work and support herself and why not? Howard, who knows, as I said in the past he is very bright on some issues, others, hmm no so much. Did anyone intentionally kill anyone, I don’t think so. Did Dr. Bubbles and Dr. Fabulous try and do the right thing, I think so, and did Howard love Anna not a question in my mind.

And in knowing the facts, could there have been better charges and other states or countries to file and charge the stooges other than California? For a law enforcement authority to charge a group or individual, they must have strong evidence that will stand on its own, some fine-tuning is always needed. Fine-tuning is one thing, but what I have seen so far in the witnesses and experts, fine-tuning, sure like trying to play a piano that fell 10 floors to crash on the street below. As I have said before, there is a great story here and some huge errors in judgment on the parts of the stooges and their minions. There will always be those who will “really” want to know what happened in the final hours of Daniel and Anna. And the biggest wild card of all, with this being Los Angeles, is the jury pool, remember, these people of the jury are the stooges’ “peers”…LMAO we will see.
