Well it’s off to the Federal Court House as this is the day that Mr. Kevin Kachikian gets his ass handed to him….so I thought. Again I was correct, there were no U.S.Marshals sitting in the courtroom waiting and it was then I realized that he was not going to jail…not today anyway.
Adam Braun, Kevin’s lawyer was as solid as he had been all along. Adam stated a few times that his client was “Kind and gentle”. I would have to agree as his client stood there in his sandals and beige slacks and sweater…simple. He made his points and presented them the best he could. And in the end Judge Fischer could just as well had taken a phone call and returned to make her delivery. This federal judge is not in the mood for going easy on the bad guys and Kachikian is one of the bad guys…but not the worst of the bunch. At one point Judge Fischer tells Kachikian “I am not the warm and friendly type”. A little like saying that I have a bit of an unusual moustache.
Kevin was present with his mother and friends, and I have to say that just like on other occasions it is the family and friends who are really hurt by this process. Kevin’s family and friends looked like just nice people. Adam Braun continued and then Kachikian addressed the court and said that he was going to “remove the rose colored glasses so as to see the red flags”…hmm, a little too late for that, don’t ya think? And in the end, Adam Braun smacked a home run and got his client out of the courthouse with a week to get his freedom secured. He was given 27 months and $2,000 fine, guilty on two counts…not bad. This will be done with his mother putting her home on the block. It was at this time that the judge made her “warm fuzzy” comment, as she would take whatever is being used to secure his freedom! Saunders and Lally did not throw any major blocks on this either…it was a day that showed a some compassion for the little people. Saunders did say that he felt that he was a threat and the usual…however, in the end the judge sorta/kinda went with Mr. Braun on this part…(the only time she was nice to Mr. Braun I thought). Don’t get me wrong, I did not say they did not do their job, oh they made it clear what they thought of this big liar, aka Da Computer Geek. The judge also made her position very clear and in the end it did appear that Kachikian got a similar break as did Terry Christensen, for a fraction of the cost! Was not easy, but Braun did a good job!

Does the judge even know that there are “jail” alternatives?
In this economy why send people to jail for non violent crimes? Make them pay the fee and make them pay for their jail at home as well.
This way we wouldn’t have to house and feed them for 10 years!
May be this is one reason we are in this crisis!
We just love putting people in Jail for silly reasons…let’s think here. Violent criminals get LESS time and are released early.
I don’t know about any of you, but I would still sleep well at night if these 3 idiots were paying for their crimes via house arrest , as opposed to all the rapist, murderers, violent offenders, molesters etc that are FREE in our streets based on early release and or small sentences. Having these 3 idiots in Jail does not make a slight difference to society (other than we have to now spend MORE money on them)….house arrest and making them pay for house arrest along with the fine would have been more RECESSION appropriate!
This way they can NOT go anywhere but home AND they pay for this and the fine. And what does the tax payer pay…ZERO!
And my point was its a NON violent crime and with the USA and the world hurting like we are, does it make sense to to jail non violent offenders? NO it does not. You can NOT just keep stuffing these jails for ridiculous laws and keep violent offenders on the streets because of budget and over crowding!
JUST THINK AMERICA….if NON violent offenders can pay for their house arrest AND the fines AND this keeps the jails less crowded for VIOLENT offenders and helps the budget….THINK ABOUT IT …IT ONLY MAKES SENSE..but we all know since this is the planet of idiots.. most cant think out of the box and this is EXACTLY why we are in this problem.
Jail away Mr. court system and lets just starve the nation so a wire tapper can go to jail and that will make us all safe…give me a break. Leave the jails free for the REAL criminals! JUST THINK ABOUT IT PEOPLE…JUST THINK ABOUT IT!
The prison system in the us incarcerates 1 % of its citizens, that more than Russia and china combines and 10x that of Europe or japan.
people who pass bad checks should be made to pay restitution. thay can suffer house arrest except for time working, this way that can actually pay for it, contribute to the economy, and sustain their families!!!!
our country does not have worse people than the rest of the world, we just have a ridiculous system of incentives for prosecutors.
I agree 100% that Judge Fischer, the prosecutors and the FBI are heroes! And I agree that they did their duty. Dirty cops are the worst!
But that was NOT my point!
Why don’t you tell people that need medical care and cant afford it, seniors that cant obtain certain services, people that get their tires ripped up and cant afford new ones based on deteriorating streets (pot holes) etc , tell them that they cant get these services because we put 3 idiots in jail for a NON violent crime. I NEVER said free them! JUST FREE THE TAXPAYER

I have asked a few questions on Roses of you before.
But what do you mean his mothers home on the block.
For a $2,000 dollar fine???
What am I missing?
He didn’t let his mum pay his fine did he?
What do you mean the judge would take anything to secure his freedom?
I know, but the I get lost with the differences to our systems.

Heath, I think numbers got crossed, Judge Fischer wanted a more substantial amount of money to secure Kevin’s release. The Federal Courts act as the ‘bail agent’ and hold the collateral and or cash. It was to be closer to 200,000.00 up from 100,000.00
State Courts one hires a ‘Bail Bonds’and they will put up the ‘bond’ for a fraction of the cost.
example: 100,000.00 would be 10% or $ 10,000.00 that someone would have to pay to get the bail bonds to cover the 100,000.00 and now it is also popular to even lower the percentage to 6, 7, 8, 9 percent.
